電視節(jié)目名稱的法律保護

【摘要】:對于節(jié)目名稱,因為其影響范圍的廣泛和商業(yè)價值的擴大化,使得社會對于該項名稱權(quán)利進行廣泛關(guān)注。在我國立法層,節(jié)目名稱的商品化的權(quán)利,沒有得到認可,現(xiàn)行的著作權(quán)法等相關(guān)法律也不能對節(jié)目名稱的相關(guān)權(quán)利進行有效的保障,至今,對于與此相關(guān)的爭議,難以得到解決。本文從商標(biāo)法等角度闡述當(dāng)前存在的諸多問題,綜合現(xiàn)如今的法治現(xiàn)實情況和和對節(jié)目名稱的保護模式的相關(guān)建議,更好的解決與節(jié)目名稱存在的相關(guān)沖突,更好的對節(jié)目名稱進行保護。首先在相關(guān)理論基礎(chǔ)上,闡述了電視節(jié)目名稱法律保護的必要性,包括有利于創(chuàng)新型社會的構(gòu)建、降低電視行業(yè)的投資風(fēng)險、激發(fā)電視節(jié)目制作者的創(chuàng)造熱情等方面。論文分析了電視節(jié)目名稱法律保護的法律關(guān)系,明確了電視節(jié)目名稱法律保護的內(nèi)容、主體與客體等。其次分析了電視節(jié)目名稱法律保護的現(xiàn)狀與問題。我國現(xiàn)行法律中并沒有關(guān)于電視節(jié)目名稱的法律保護的明文規(guī)定,對于電視節(jié)目名稱的法律保護也都是圍繞著商標(biāo)法、著作權(quán)法和反不正當(dāng)競爭法等知識產(chǎn)權(quán)領(lǐng)域法律開展的。在電視節(jié)目名稱法律保護的問題分析上,論文提出了電視節(jié)目名稱商標(biāo)化的問題與弊端,電視節(jié)目名稱與著作權(quán)的權(quán)利差異,反不正當(dāng)競爭法保護電視節(jié)目名稱的局限等問題。最后提出完善建議。首先,在立法中,對于節(jié)目名稱,應(yīng)賦予其商品化權(quán),并把該項商品化權(quán)利限定在特定的范圍內(nèi);其次,對于節(jié)目名稱的保護,包含馳名節(jié)目的保護;最后,在本文中,提出構(gòu)架節(jié)目名稱保護的橫向和縱向體系。本文通過研究對節(jié)目名稱的法律保護,提出節(jié)目名稱權(quán)利的出路和保護模式,以求促成對其進行深入研究,并期許能夠?qū)?quán)利人進行一定的幫助。
[Abstract]:For the program name, because of its wide range of influence and the expansion of commercial value, the society pays more and more attention to the name right. In the legislative level of our country, the right to commercialize the program name has not been recognized, and the current copyright law and other relevant laws can not effectively protect the related rights of the program name. Up to now, it is difficult to solve the related disputes. This paper expounds many existing problems from the perspective of trademark law, synthesizes the current reality of the rule of law and the relevant suggestions on the protection mode of the program name, better solves the related conflicts with the program name, and better protects the program name. First of all, on the basis of the relevant theories, this paper expounds the necessity of legal protection of TV program names, including the aspects of conducive to the construction of innovative society, reducing the investment risk of television industry, stimulating the creative enthusiasm of TV program producers, and so on. This paper analyzes the legal relationship of the legal protection of the name of the TV program, and clarifies the content, subject and object of the legal protection of the name of the TV program. Secondly, it analyzes the present situation and problems of the legal protection of TV program names. There are no explicit provisions on the legal protection of TV program names in the current laws of our country, and the legal protection of TV program names is also carried out around trademark law, copyright law and anti-unfair competition law in the field of intellectual property rights. On the analysis of the legal protection of the name of the TV program, this paper puts forward the problems and disadvantages of the trademark of the name of the TV program, the difference of the rights between the name of the TV program and the copyright, and the limitation of protecting the name of the TV program by the anti-unfair competition law. Finally, some suggestions are put forward for improvement. First of all, in the legislation, the program name should be given the right of commercialization, and the commercialization right should be limited to a specific range; secondly, the protection of the program name includes the protection of well-known programs; finally, in this paper, the horizontal and vertical systems of program name protection should be constructed. Through the study of the legal protection of the program name, this paper puts forward the way out and the protection mode of the program name right, in order to promote the in-depth study of the program name right, and hope that it can be of some help to the obligee.
