【摘要】：自計(jì)算機(jī)軟件產(chǎn)生到現(xiàn)在軟件已然成為規(guī)模化產(chǎn)業(yè)，軟件知識(shí)產(chǎn)權(quán)保護(hù)問(wèn)題一直是各國(guó)法律界和司法實(shí)踐界討論的熱點(diǎn)。從上個(gè)世紀(jì)八十年代起，在美國(guó)的大力推動(dòng)下，軟件著作權(quán)法保護(hù)模式成為了主流。但是，反對(duì)的聲音從未消失過(guò)。 隨著技術(shù)的發(fā)展，著作權(quán)保護(hù)模式的缺陷日益凸顯。各國(guó)開(kāi)始尋求探索軟件專利保護(hù)方式。在一些國(guó)家地區(qū)，己經(jīng)開(kāi)始對(duì)軟件授予專利，實(shí)施專利保護(hù)。近年來(lái)，新興起的云計(jì)算技術(shù)服務(wù)對(duì)軟件傳播模式等產(chǎn)生了重大影響，現(xiàn)行的軟件著作權(quán)保護(hù)模式也受到了巨大的挑戰(zhàn)。 本文從軟件和云計(jì)算技術(shù)基本概念和特點(diǎn)著手，分析了在云計(jì)算Saas模式對(duì)軟件知識(shí)產(chǎn)權(quán)保護(hù)影響以及傳統(tǒng)保護(hù)方式的局限。重點(diǎn)介紹了美國(guó)、日本和歐洲軟件專利保護(hù)的發(fā)展歷程和對(duì)新技術(shù)的應(yīng)對(duì)方式。通過(guò)分析現(xiàn)行爭(zhēng)議的幾種軟件保護(hù)模式，探究各自的優(yōu)缺點(diǎn)，并借鑒國(guó)外經(jīng)驗(yàn)，結(jié)合新技術(shù)Saas模式的特點(diǎn)及其環(huán)境下軟件傳播的特點(diǎn)，，筆者提出懫用以專利保護(hù)核心，商業(yè)秘密保護(hù)相輔助的知識(shí)產(chǎn)權(quán)保護(hù)解決方案。并介紹了我國(guó)軟件知識(shí)產(chǎn)權(quán)保護(hù)現(xiàn)狀，結(jié)合前述分析，最后針對(duì)我國(guó)軟件知識(shí)產(chǎn)權(quán)保護(hù)提出了筆者的完善建議。
[Abstract]:Since the computer software has become a large-scale industry, the protection of the intellectual property rights of the software has been a hot issue in the field of legal and judicial practice in all countries. Since the eighties of the last century, the protection mode of the software copyright law has become the mainstream under the vigorous promotion of the United States. However, the sound of the objection has never disappeared. With the development of technology, the defect of copyright protection mode is becoming more and more convex D. In recent years, the new cloud computing technology service has a great influence on the software communication mode and so on, and the current software copyright protection mode has also been greatly selected In this paper, from the basic concept and characteristics of software and cloud computing technology, this paper analyzes the influence of the Saas mode on the protection of the software and the traditional protection mode in the cloud computing Saas mode. The paper introduces the development of software patent protection in the United States, Japan and Europe, and the application of new technology to the new technology. In this paper, through the analysis of several software protection modes in the current dispute, the advantages and disadvantages of the present dispute are explored, and the characteristics of the new technology Saas mode and the characteristics of the software communication in the environment are discussed.
