論知識(shí)產(chǎn)權(quán)公共政策

【摘要】:從公共政策的視角來(lái)看,知識(shí)產(chǎn)權(quán)的本質(zhì)乃是隸屬于其下的一種政府謀求發(fā)展、平衡利益的工具。經(jīng)各國(guó)的實(shí)踐發(fā)現(xiàn),對(duì)知識(shí)資源的合理配置可以促進(jìn)經(jīng)濟(jì)和社會(huì)的發(fā)展。在知識(shí)產(chǎn)權(quán)戰(zhàn)略在社會(huì)經(jīng)濟(jì)發(fā)展中的地位日益重要的今天,對(duì)知識(shí)產(chǎn)權(quán)公共政策不斷地深入研究,具有重要的現(xiàn)實(shí)意義。 本文從國(guó)際知識(shí)產(chǎn)權(quán)公共政策沿革出發(fā),揭示知識(shí)產(chǎn)權(quán)公共政策的有效配置對(duì)經(jīng)濟(jì)社會(huì)發(fā)展的重要作用;總結(jié)出我國(guó)知識(shí)產(chǎn)權(quán)公共政策的演進(jìn),分析了國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略實(shí)施的成效;探析地區(qū)知識(shí)產(chǎn)權(quán)實(shí)力差距的公共政策因素,揭示知識(shí)產(chǎn)權(quán)公共政策與地區(qū)發(fā)展間的關(guān)聯(lián);指出了我國(guó)知識(shí)產(chǎn)權(quán)公共政策上的一些問(wèn)題,并提出了幾點(diǎn)建議。 全文共分為五大部分。 第一部分介紹了與知識(shí)產(chǎn)權(quán)公共政策相關(guān)的基本概念;限定了以政府為主體的政策決定層;指明了法律是一種實(shí)施時(shí)間較長(zhǎng)、相對(duì)穩(wěn)定的公共政策;從廣義上闡明知識(shí)產(chǎn)權(quán)公共政策的制定主體包括國(guó)家和地方政府;介紹了與知識(shí)產(chǎn)權(quán)密切相關(guān)的公共政策領(lǐng)域,這些領(lǐng)域與知識(shí)產(chǎn)權(quán)公共政策存在著交叉的關(guān)系。 第二部分論述了國(guó)際上知識(shí)產(chǎn)權(quán)公共政策的產(chǎn)生、發(fā)展的歷程與規(guī)律。分析出各國(guó)為了平衡公眾的利益、發(fā)展其自身的經(jīng)濟(jì)的知識(shí)產(chǎn)權(quán)公共政策發(fā)展導(dǎo)向;揭示了歐美等發(fā)達(dá)國(guó)家通過(guò)不斷調(diào)整公共政策的手段實(shí)現(xiàn)社會(huì)經(jīng)濟(jì)的飛躍,這對(duì)我國(guó)的知識(shí)產(chǎn)權(quán)公共政策建置不乏重要啟示,為我國(guó)知識(shí)產(chǎn)權(quán)戰(zhàn)略的制定提供了有益借鑒。 第三部分概括出我國(guó)對(duì)于知識(shí)產(chǎn)權(quán)的政策建置由被動(dòng)逐漸轉(zhuǎn)為主動(dòng)再到知識(shí)產(chǎn)權(quán)意識(shí)覺醒的過(guò)程,揭示知識(shí)產(chǎn)權(quán)制度對(duì)國(guó)家經(jīng)濟(jì)社會(huì)發(fā)展的重要影響,分析了國(guó)家公共政策對(duì)知識(shí)產(chǎn)權(quán)制度建立和發(fā)展的關(guān)鍵作用。同時(shí)還總結(jié)出國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略的實(shí)施成效,旨在說(shuō)明現(xiàn)階段我國(guó)公共政策對(duì)知識(shí)產(chǎn)權(quán)保護(hù)的狀況。 第四部分聚焦到地區(qū)知識(shí)產(chǎn)權(quán)相關(guān)的公共政策。通過(guò)地區(qū)知識(shí)產(chǎn)權(quán)實(shí)力指數(shù)客觀地指出地區(qū)知識(shí)產(chǎn)權(quán)實(shí)力的差距,并從政策層面尋求差距的解釋。列舉廣東、廣西兩地的知識(shí)產(chǎn)權(quán)政策建置的相關(guān)情況,對(duì)比分析了兩地相關(guān)政策的差異,試圖說(shuō)明良好的政策配置對(duì)地區(qū)知識(shí)產(chǎn)權(quán)發(fā)展和社會(huì)經(jīng)濟(jì)實(shí)力的促進(jìn)作用。 第五部分指出了我國(guó)目前在知識(shí)產(chǎn)權(quán)公共政策建置上的一些不足,提出我國(guó)的知識(shí)產(chǎn)權(quán)公共政策應(yīng)當(dāng)隨著時(shí)代的發(fā)展與時(shí)俱進(jìn),最后列出幾點(diǎn)完善我國(guó)知識(shí)產(chǎn)權(quán)公共政策的建議。
[Abstract]:From the perspective of public policy, the essence of intellectual property is a tool for government to seek development and balance interests. Through the practice of various countries, it is found that the rational allocation of knowledge resources can promote the development of economy and society. Nowadays, the intellectual property strategy plays an increasingly important role in the development of society and economy, and it is of great practical significance to study the public policy of intellectual property continuously. Starting from the evolution of international public policies on intellectual property rights, this paper reveals the important role of effective allocation of public policies on intellectual property rights on economic and social development. This paper summarizes the evolution of the public policy on intellectual property rights in China, analyzes the effectiveness of the implementation of the national intellectual property strategy, probes into the public policy factors of the regional intellectual property power gap, and reveals the relationship between the public policy on intellectual property rights and regional development. This paper points out some problems in the public policy of intellectual property rights in China, and puts forward some suggestions. The full text is divided into five parts. The first part introduces the basic concepts related to the public policy of intellectual property rights, defines the policy decision layer with the government as the main body, and points out that the law is a relatively stable public policy with a long implementation time. This paper expounds in broad sense that the subjects of making public policies on intellectual property rights include national and local governments, and introduces the areas of public policies closely related to intellectual property rights, which are cross-linked with public policies on intellectual property rights. The second part discusses the emergence and development of public policy on intellectual property rights in the world. In order to balance the interests of the public and develop their own economic public policies of intellectual property rights, the paper analyzes the development orientation of public policies of intellectual property rights. It reveals that the developed countries, such as Europe and the United States, have realized the leap of social economy by means of constant adjustment of public policies, which is of great significance to the establishment of public policies on intellectual property rights in China, and provides a useful reference for the formulation of intellectual property strategy in China. The third part summarizes the process of the policy establishment of intellectual property rights in China from passive to active and then to the awakening of intellectual property consciousness, and reveals the important influence of intellectual property system on the economic and social development of the country. This paper analyzes the key role of national public policy in the establishment and development of intellectual property rights system. At the same time, it also summarizes the effectiveness of the implementation of the national intellectual property strategy, in order to illustrate the current situation of the protection of intellectual property rights by public policies in China. The fourth part focuses on the regional intellectual property rights-related public policies. Through the regional intellectual property power index objectively points out the regional intellectual property strength gap, and from the policy level to seek the gap explanation. This paper enumerates the related situation of intellectual property policy establishment in Guangdong and Guangxi, compares and analyzes the difference of the related policy between the two places, and tries to explain the promoting effect of good policy configuration on the development of intellectual property rights and social and economic strength in the region. The fifth part points out some deficiencies in the establishment of public policies on intellectual property rights in China, and puts forward that the public policies on intellectual property rights in our country should keep pace with the times with the development of the times. Finally, it lists some suggestions to perfect the public policy of intellectual property rights in China.
