【摘要】：在法典化國家中,知識產(chǎn)權(quán)自其問世始,始終與民法典存在著互動(dòng)關(guān)系。其通過立法形式而表現(xiàn)出民法典對知識產(chǎn)權(quán)私權(quán)性質(zhì)的體系判斷和知識產(chǎn)權(quán)對民法典內(nèi)容的充實(shí)。近代法典化思維源于羅馬法的法典化思維及體系要素的思考,但受制于社會(huì)商品經(jīng)濟(jì)的發(fā)展水平、科學(xué)技術(shù)的發(fā)展水平尤其是人們對知識信息重要性及商品性的認(rèn)識程度,近代民法法典化初萌的成果中未將人們對知識信息的創(chuàng)造性或創(chuàng)作性成果納入其法典體系要素中。但當(dāng)有關(guān)知識產(chǎn)權(quán)的理論和實(shí)踐面對“權(quán)利”時(shí),源于羅馬法的民法典之私權(quán)理念就直接引導(dǎo)著知識產(chǎn)權(quán)的立法制度價(jià)值與功能并決定了知識產(chǎn)權(quán)的立法體系定位。意大利、俄羅斯等國民法典與知識產(chǎn)權(quán)的緊密契合式的互動(dòng)值得我們關(guān)注。對我國而言,通過民法典與單行法“二元”立法結(jié)構(gòu)來實(shí)現(xiàn)知識產(chǎn)權(quán)與民法典的互動(dòng)是一個(gè)值得嘗試的立法路徑。
[Abstract]:In codified countries, intellectual property has been interacted with civil code since it came into being. Through the form of legislation, it shows the systematic judgment of the nature of private rights of intellectual property rights and the enrichment of the contents of the civil code by intellectual property rights. The modern codification thinking originated from the codification thinking of Roman law and the thinking of the system elements, but was restricted by the development level of the social commodity economy, the level of development of science and technology, especially the degree of people's understanding of the importance of knowledge and information and the commercialization. In the early achievements of codification of modern civil law, people's creative or creative achievements on knowledge and information have not been incorporated into the elements of their codification system. However, when the theory and practice of intellectual property rights are faced with "rights", the concept of private rights derived from Roman law directly guides the value and function of the legislative system of intellectual property rights and determines the orientation of the legislative system of intellectual property rights. Italy, Russia and other civil codes and intellectual property rights closely compatible interaction worthy of our attention. For our country, it is a worthy legislative path to realize the interaction between intellectual property and civil code through the "dual" legislative structure between civil code and single law.
