【摘要】：漢字是人們用來表達意思、傳承文化的工具,已走過五千多年的歷史,它不僅是中華民族的瑰寶,更在世界文化藝術(shù)寶庫中獨放異彩。而字體作為漢字的外在表現(xiàn)形式,更是增強了其視覺傳達效果,使其上升到可供人欣賞的藝術(shù)品高度。然而隨著近年來字體字型案件的頻繁出現(xiàn),使其字體侵權(quán)這一話題成為社會關(guān)注的焦點。其影響力與關(guān)注度前所未有。 本文以字體的概念為切入點,詳細(xì)闡述了字體相關(guān)概念的區(qū)別,并以此為基礎(chǔ)總結(jié)出字體的基本特征。通過對國內(nèi)外字體知識產(chǎn)權(quán)保護現(xiàn)狀的分析,闡述了國外字體知識產(chǎn)權(quán)保護的法律模式,并從中指出我國字體知識產(chǎn)權(quán)保護存在的缺陷。最后在通過對字體的著作權(quán)保護與外觀設(shè)計專利保護的學(xué)理分析下,詳細(xì)論述了中文字體的著作權(quán)保護及字體外觀設(shè)計專利保護的可行性,并以此為基礎(chǔ)對構(gòu)建我國字體知識產(chǎn)權(quán)制度提出相應(yīng)的建議。
[Abstract]:The Chinese character is the tool which people use to express the meaning and inherit the culture. It has passed through more than five thousand years of history. It is not only the treasure of the Chinese nation, but also the unique splendor in the treasure house of the world culture and art. As the external expression of Chinese characters, the font enhances its visual communication effect and makes it rise to the level of works of art that people can appreciate. However, with the frequent emergence of font cases in recent years, the topic of font infringement has become the focus of attention. Its influence and attention are unprecedented. In this paper, the concept of font as a breakthrough point, elaborated the font related concepts, and on the basis of the font summarized the basic characteristics of the font. Based on the analysis of the current situation of the protection of intellectual property rights of fonts at home and abroad, this paper expounds the legal mode of protection of intellectual property rights of fonts in foreign countries, and points out the defects in the protection of intellectual property rights of fonts in China. Finally, based on the theoretical analysis of the copyright protection of fonts and the patent protection of exterior design, the feasibility of copyright protection of Chinese fonts and patent protection of appearance design of fonts is discussed in detail. On the basis of this, some suggestions are put forward to construct the intellectual property system of fonts in China.
