中國第四代移動通信技術專利保護策略研究

【摘要】:第四代移動通信技術是當前通信領域的熱點話題,關鍵技術的發(fā)展方向決定著行業(yè)的整體走向。對高新技術產(chǎn)業(yè)而言,專利信息蘊含著巨大價值,專利戰(zhàn)略是知識產(chǎn)權時代企業(yè)戰(zhàn)略的重要組成部分。在2G和3G時代,中國企業(yè)的知識產(chǎn)權意識并不強,而眾多跨國企業(yè)借助其自身雄厚的科研實力和技術積累在中國實現(xiàn)了大規(guī)模的專利覆蓋,使得眾多中國通信企業(yè)在被動的局勢里無力突圍。隨著4G時代的到來,國內(nèi)廠商已意識到專利的重要性,均紛紛開始建立自己的專利堡壘。因此,有必要對第四代移動通信及其關鍵技術進行鑒定,并對關鍵技術領域的專利分布情況以及主要申請人專利布局以及保護策略進行討論研究。知識產(chǎn)權尤其是專利已經(jīng)成為當下通信行業(yè)規(guī)避經(jīng)營風險提高核心競爭力的重要戰(zhàn)略武器。 本文將第四代移動通信技術領域的專利作為研究對象,在專利信息檢索的基礎上,,對全球第四代移動通信技術的專利信息進行了實證研究。然后將研究結(jié)果進行歸納整理,在此基礎上羅列出第四代移動通信技術領域?qū)嵙妱诺膰�,并進一步將其與中國4G移動通信進行對比研究,總結(jié)兩者之間的戰(zhàn)略差異;再對全球4G移動通信技術領域主要專利申請人進行信息分析和挖掘,最后綜合上述結(jié)論,結(jié)合自己的思考給出第四代移動通信技術的專利保護策略,以期為中國第四代移動通信的發(fā)展提供有益借鑒。研究發(fā)現(xiàn): 第一,第四代移動通信技術在全球范圍內(nèi)展開了激烈的專利布局;中、美兩國是最為主要的兩個市場,其次是日本、韓國和歐洲地區(qū); 第二,中、美兩國在4G領域已成為互相最為強勁的對手;中國在專利數(shù)量上具有優(yōu)勢,但美國在專利質(zhì)量上遠超中國;并且美國通信技術各分支領域發(fā)展平衡,擁有大量的大型跨國企業(yè)代表;而中國掌握的核心技術數(shù)量還有待提高,并且企業(yè)實力兩極分化明顯; 第三,移動通信領域的大型跨國企業(yè)均具有實力雄厚的專利資源庫,不僅在專利數(shù)量上具有優(yōu)勢,在質(zhì)量上也有所保障;他們致力于將創(chuàng)新成果向?qū)@D(zhuǎn)化,維護自身權益的同時更將專利技術融入標準技術以獲取更大的利益。并且,他們運用自主研發(fā)申請、對外收購、交叉許可等手段對專利進行有效運營,因此值得我國相關企業(yè)學習借鑒。
[Abstract]:The fourth generation mobile communication technology is a hot topic in the current communication field. The development direction of the key technology determines the overall trend of the industry. For high-tech industry, patent information contains great value, patent strategy is an important part of enterprise strategy in the era of intellectual property. In the era of 2G and 3G, the intellectual property awareness of Chinese enterprises is not strong, and many multinational enterprises have realized large-scale patent coverage in China with the help of their own strong scientific research strength and technology accumulation. So that many Chinese telecommunications enterprises in the passive situation is unable to break through. With the arrival of 4G era, domestic manufacturers have realized the importance of patents and have begun to build their own patent fortress. Therefore, it is necessary to identify the fourth generation mobile communication and its key technologies, and to discuss the distribution of patents in the key technology areas, the patent layout of the main applicants and the protection strategy. Intellectual property, especially patents, has become an important strategic weapon for the communication industry to avoid operating risks and improve core competitiveness. In this paper, the fourth generation of mobile communication technology patents as the research object, on the basis of patent information retrieval, the fourth generation of global mobile communications technology patent information empirical research. Then the research results are summarized and sorted out on the basis of which the fourth generation mobile communication technology field strength countries are listed and further compared with China 4G mobile communication to sum up the strategic differences between the two; After analyzing and excavating the main patent applicants in the field of 4G mobile communication technology in the world, the author synthesizes the above conclusions and gives the patent protection strategy of the fourth generation mobile communication technology combined with his own thinking. In order to provide useful reference for the development of the fourth generation mobile communication in China. The findings are as follows: first, the fourth generation mobile communication technology has launched the fierce patent layout in the global scope, China and the United States are the two most important markets, followed by Japan, South Korea and Europe; Second, China and the United States have become the strongest rivals in 4G, while China has an advantage in the number of patents, but the United States is far superior to China in the quality of patents. All branches of communication technology in the United States have a balanced development, with a large number of representatives of large multinational enterprises, while the number of core technologies in China needs to be improved, and the strength of enterprises is clearly polarized. Third, the large multinational enterprises in the field of mobile communication have a strong patent resource base, which not only has advantages in the number of patents, but also has some guarantee in quality; They are committed to transforming innovation into patents, protecting their own rights and interests, and integrating patent technology into standard technology to achieve greater benefits. Moreover, they use independent R & D applications, foreign acquisitions, cross-licensing and other means to effectively operate patents, so it is worth learning from relevant enterprises in our country.
