【摘要】：我國專利確權(quán)機(jī)制的完善已經(jīng)成為實施創(chuàng)新驅(qū)動發(fā)展戰(zhàn)略和國家知識產(chǎn)權(quán)戰(zhàn)略的重要支撐�，F(xiàn)行專利確權(quán)機(jī)制運行的低效率導(dǎo)致了諸多的利益沖突,促使我國專利法的歷次修改都將完善我國現(xiàn)行專利確權(quán)機(jī)制作為重要內(nèi)容。通過對我國現(xiàn)行專利確權(quán)機(jī)制相關(guān)變革方案以及國際專利確權(quán)機(jī)制的發(fā)展趨勢予以分析,在此基礎(chǔ)上提出了完善建議,以期為我國專利確權(quán)的理論研究和機(jī)制完善提供新的視角和參考。
[Abstract]:The perfection of patent confirmation mechanism in China has become an important support for the implementation of innovation-driven development strategy and national intellectual property strategy. The inefficient operation of the current patent confirmation mechanism has led to many conflicts of interest. It is an important content to perfect the current patent confirmation mechanism in each revision of the patent law of our country. Based on the analysis of the relevant reform schemes of the current patent confirmation mechanism in China and the development trend of the international patent confirmation mechanism, the author puts forward some suggestions on how to improve the patent confirmation mechanism. In order to provide a new perspective and reference for the theoretical research and mechanism improvement of patent right in China.
