【摘要】：當代國際知識產(chǎn)權保護一體化立法正不斷推進的同時,世界各國對于知識產(chǎn)權的保護需求仍然無法達成高度共識。而知識產(chǎn)權法作為沖突規(guī)范中一項不可或缺的法律規(guī)則,對如何解決涉外知識產(chǎn)權問題具有相當重要的理論與實踐意義。本文以涉外知識產(chǎn)權法律適用的基礎理論入手,分析了涉外知識產(chǎn)權法在實踐中的運用,以期業(yè)界同行共同交流探討。
[Abstract]:At the same time, while the legislation of international intellectual property protection integration is advancing continuously, the countries all over the world still cannot reach a high consensus on the protection demand of intellectual property rights. As an indispensable legal rule in conflict norms, intellectual property law has important theoretical and practical significance on how to solve the problem of foreign intellectual property rights. Based on the basic theory of the application of foreign intellectual property law, this paper analyzes the application of foreign intellectual property law in practice, with a view to the exchange and discussion of the industry.
