【摘要】：本文以數(shù)大保險公司航保中心的建立為切入點(diǎn),對我國航運(yùn)保險產(chǎn)品創(chuàng)新的法律環(huán)境狀況及缺陷進(jìn)行了較為詳細(xì)的分析,目的在于對我國航運(yùn)保險產(chǎn)品的法律環(huán)境完善提出實(shí)質(zhì)性的建議,以突破我國航運(yùn)保險業(yè)的發(fā)展瓶頸,為我國實(shí)現(xiàn)從“航運(yùn)大國”到“航運(yùn)強(qiáng)國”的跨越式發(fā)展提供動力。 文章的引言是本文的寫作背景,數(shù)大保險公司近年來新成立的航保中心無疑是促進(jìn)航運(yùn)保險產(chǎn)品發(fā)展的重大事件,極大地刺激了上海港周邊乃至全國的航運(yùn)保險業(yè)發(fā)展。 第一章為文章概述。首先通過對“航運(yùn)保險”和“航運(yùn)保險產(chǎn)品”的概念分析來界定文章論述的外延部分；其次是我困航運(yùn)保險產(chǎn)品的發(fā)展現(xiàn)狀及其創(chuàng)新的必要性,與之后的法律環(huán)境對航運(yùn)保險產(chǎn)品創(chuàng)新的意義一起構(gòu)成了本文的寫作目的,即通過對法律的改革創(chuàng)新來保障航運(yùn)保險產(chǎn)品創(chuàng)新的可實(shí)施性。 第二章為我國航運(yùn)保險產(chǎn)品創(chuàng)新的法律環(huán)境狀況及缺陷。對保險產(chǎn)品新主體多元化提出了新的構(gòu)思,并且依靠稅法、知識產(chǎn)權(quán)法的法律環(huán)境的完善對主體創(chuàng)新的積極性提出保障。 第三章為本文的重點(diǎn),即對我國航運(yùn)保險產(chǎn)品創(chuàng)新的法律環(huán)境完善提出了立法建議。這部分以一一對應(yīng)的方式對上一章中論及的缺陷問題提供了具體的法律依據(jù),希望通過這些建議彌補(bǔ)目前法律體系中仍然存在的缺陷,對航運(yùn)保險產(chǎn)品的創(chuàng)新提供堅強(qiáng)的法律后盾,為我國航運(yùn)保險業(yè)乃至航運(yùn)業(yè)的發(fā)展盡一份綿薄之力。
[Abstract]:Based on the establishment of aviation insurance center of several major insurance companies, this paper makes a detailed analysis of the legal environment and defects of the innovation of shipping insurance products in China. In order to break through the bottleneck of the development of China's shipping insurance industry and provide impetus for the leapfrogging development from "big shipping country" to "shipping power country", the purpose of this paper is to put forward substantive suggestions on the perfection of the legal environment of shipping insurance products in China. The introduction of this article is the background of this paper. The newly established shipping insurance center established by several major insurance companies in recent years is undoubtedly an important event to promote the development of shipping insurance products, which has greatly stimulated the development of shipping insurance industry around Shanghai Port and even in the whole country. The first chapter is the summary of the article. First of all, by analyzing the concept of "shipping insurance" and "shipping insurance products" to define the extension part of the article, secondly, the development status and the necessity of innovation of our shipping insurance products. Together with the significance of the legal environment to the innovation of shipping insurance products, the purpose of this paper is to ensure the implementability of the innovation of shipping insurance products through the reform and innovation of the law. The second chapter is the legal environment and defects of shipping insurance product innovation in China. This paper puts forward a new conception for the diversification of the new subject of insurance products, and relies on the perfection of the legal environment of tax law and intellectual property law to guarantee the initiative of subject innovation. The third chapter is the emphases of this paper, that is, to perfect the legal environment of shipping insurance product innovation in our country. This part provides a specific legal basis for the defects discussed in the previous chapter in a one-to-one manner, and hopes to make up for the shortcomings that still exist in the current legal system through these recommendations. It provides a strong legal backing for the innovation of shipping insurance products, and contributes a little to the development of China's shipping insurance industry and even shipping industry.
