【摘要】：本文是一篇翻譯報(bào)告，所譯原文是美國(guó)A123Systems與日本IHI公司于2011年11月3日簽訂的一份《技術(shù)許可協(xié)議》。該協(xié)議的許可人是美國(guó)A123Systems, Inc.，其不僅擁有卓越的鋰離子電池技術(shù)，同時(shí)又是一家鋰離子電池和電池系統(tǒng)的垂直一體化供應(yīng)商；被許可人IHI公司，是日本最大的重工業(yè)設(shè)備制造商之一。根據(jù)協(xié)議內(nèi)容，IHI將獨(dú)家供應(yīng)日本運(yùn)輸系統(tǒng)市場(chǎng)上所需的A123電池系統(tǒng)和模塊，以向日本交通運(yùn)輸、工業(yè)和海運(yùn)市場(chǎng)的潛在客戶提供服務(wù)。 本翻譯報(bào)告分為四部分，，第一章為引言，包括項(xiàng)目的背景、目標(biāo)、意義和報(bào)告結(jié)構(gòu)。報(bào)告從原文是英文法律文書的背景出發(fā)，以準(zhǔn)確翻譯原文內(nèi)容和總結(jié)翻譯方法為目標(biāo)，在經(jīng)濟(jì)全球化的今天，具有為翻譯法律文書的翻譯方法提供合理化建議的翻譯意義和推廣英文合同知識(shí)及保護(hù)知識(shí)產(chǎn)權(quán)的社會(huì)意義。第二章為原文背景，介紹技術(shù)許可合同并分析原文內(nèi)容、結(jié)構(gòu)和語(yǔ)言特點(diǎn)。第三章是翻譯難點(diǎn)和翻譯方法，闡述前期準(zhǔn)備工作，針對(duì)英文合同的制式結(jié)構(gòu)，選取、研讀范本典型段落并對(duì)其進(jìn)行評(píng)析，以用其指導(dǎo)本次翻譯。第四章是總結(jié)部分。筆者對(duì)本翻譯過(guò)程進(jìn)行總結(jié)與反思，從而得出翻譯經(jīng)驗(yàn)教訓(xùn)并找出仍待解決的問(wèn)題，以期為今后的法律翻譯實(shí)踐做出積極且有益的嘗試。
[Abstract]:This paper is a translation of a Technology Licensing Agreement signed between A123Systems of the United States and IHI of Japan on November 3, 2011. The licensor of the agreement is the United States A123 Systems, Inc., which not only has excellent lithium ion battery technology, but also is a vertically integrated supplier of lithium ion batteries and battery systems; Licensee IHI, Inc. Is one of Japan's largest manufacturers of heavy industrial equipment. In accordance with the terms of the agreement, IHI will exclusively supply A123 battery systems and modules required in the Japanese transport system market to serve potential customers in the Japanese transport, industrial and shipping markets. This translation report is divided into four parts. The first chapter is the introduction, including the background, objectives, significance and report structure of the project. Proceeding from the background of the original text as an English legal instrument, the report aims at the accurate translation of the original text and the summary of the translation method. In today's economic globalization, It has the social significance of providing reasonable suggestions for the translation of legal documents and promoting the knowledge of English contracts and protecting intellectual property rights. The second chapter introduces the technical license contract and analyzes the content, structure and language characteristics of the original text. The third chapter is the translation difficulties and translation methods, expounding the preparatory work, choosing the standard structure of the English contract, reading the typical paragraphs of the model and evaluating them, in order to guide the translation. The fourth chapter is the summary part. The author sums up and reflects on the translation process in order to draw lessons from the translation experience and find out the problems still to be solved in order to make a positive and beneficial attempt for the practice of legal translation in the future.
