中國農(nóng)產(chǎn)品地理標(biāo)志保護(hù)對策研究

【摘要】:農(nóng)產(chǎn)品地理標(biāo)志是重要的區(qū)域特色農(nóng)產(chǎn)品資源和品牌,也是農(nóng)業(yè)知識產(chǎn)權(quán)和農(nóng)耕文明的重要體現(xiàn)。我國是農(nóng)產(chǎn)品地理標(biāo)志資源大國,做好農(nóng)產(chǎn)品地理標(biāo)志保護(hù)對于發(fā)展區(qū)域經(jīng)濟(jì)、打造特色品牌等方面具有重要意義。當(dāng)前我國在農(nóng)產(chǎn)品地理標(biāo)志認(rèn)知程度、管理體制、保護(hù)手段等方面還存在著很多制約發(fā)展的問題,亟需加以研究解決。 本文運用經(jīng)濟(jì)學(xué)相關(guān)理論,分析了區(qū)域經(jīng)濟(jì)、市場選擇、打假維權(quán)和國際貿(mào)易等因素對農(nóng)產(chǎn)品地理標(biāo)志保護(hù)的決定性影響。通過分析農(nóng)產(chǎn)品地理標(biāo)志與相關(guān)概念間的關(guān)系,提出了農(nóng)產(chǎn)品地理標(biāo)志具有權(quán)屬相對公共性、生產(chǎn)限定性、市場相對壟斷性、品牌效應(yīng)連帶性、物質(zhì)和非物質(zhì)整合性5個基本屬性,提出農(nóng)產(chǎn)品地理標(biāo)志應(yīng)當(dāng)重點保護(hù)獨特的自然生態(tài)環(huán)境、生產(chǎn)方式、產(chǎn)品品質(zhì)和人文歷史4個核心要素,并對農(nóng)產(chǎn)品地理標(biāo)志保護(hù)的生態(tài)效益、經(jīng)濟(jì)效益和社會效益進(jìn)行了深入分析。 在總結(jié)發(fā)展歷程的基礎(chǔ)上,對國際農(nóng)產(chǎn)品地理標(biāo)志保護(hù)取向和歐盟、美國、西班牙等典型國家(地區(qū))農(nóng)產(chǎn)品地理標(biāo)志保護(hù)制度進(jìn)行了系統(tǒng)分析,提出了國外發(fā)展特點及對我國的借鑒。系統(tǒng)研究了我國地理標(biāo)志“一套名稱、兩種模式、三個部門”的管理體制,全面分析了農(nóng)業(yè)、工商、質(zhì)檢三個部門在開展地理標(biāo)志保護(hù)工作的法律依據(jù)、部門職能、登記程序、標(biāo)志管理等情況,對比分析了各部門的優(yōu)勢和劣勢,提出了完善我國農(nóng)產(chǎn)品地理標(biāo)志管理體制的思路和方向。 論文在全國范圍內(nèi)對種植、畜牧、漁業(yè)三個行業(yè)和東部、中部、西部和東北四大地區(qū)農(nóng)產(chǎn)品地理標(biāo)志資源開展了全方位調(diào)查,對農(nóng)業(yè)、工商、質(zhì)檢三個部門登記注冊的農(nóng)產(chǎn)品地理標(biāo)志分別進(jìn)行了系統(tǒng)分析。根據(jù)行業(yè)調(diào)查結(jié)果,提出了稻米等6類特色資源的發(fā)展重點,建立了用于判斷地區(qū)或行業(yè)發(fā)展重點的優(yōu)勢潛力指數(shù)R模型,據(jù)此模型對四大地區(qū)及各省份、各行業(yè)發(fā)展情況進(jìn)行了深入分析,提出了相應(yīng)農(nóng)產(chǎn)品地理標(biāo)志發(fā)展策略建議。 通過全面的問卷調(diào)查,對農(nóng)產(chǎn)品地理標(biāo)志政府管理者、登記持有人、標(biāo)志使用人、市場消費者等相關(guān)行為主體進(jìn)行了策略分析,全面研究了產(chǎn)業(yè)發(fā)展、政策制度、質(zhì)量控制、標(biāo)志使用、市場推廣、消費意愿等方面情況,深入分析了存在問題及產(chǎn)生原因,并對農(nóng)產(chǎn)品地理標(biāo)志生產(chǎn)企業(yè)、消費者、政府等相關(guān)行為主體進(jìn)行了博弈分析,提出了均衡策略。 最后,在綜合分析基礎(chǔ)上,本文從管理制度、技術(shù)支撐、服務(wù)保障3個方面,提出了進(jìn)一步完善我國農(nóng)產(chǎn)品地理標(biāo)志保護(hù)的對策建議。
[Abstract]:Geographical indication of agricultural products is an important regional characteristic of agricultural resources and brands, is also an important embodiment of agricultural intellectual property rights and agricultural civilization. China is a large country of agricultural products geographical indication resources. It is of great significance to protect agricultural products geographical indications for the development of regional economy and the creation of special brands. At present, there are still a lot of problems restricting the development of agricultural products in the aspects of geographical indication cognition, management system, protection means and so on, which need to be studied and solved. Based on the relevant theories of economics, this paper analyzes the decisive influence of regional economy, market choice, anti-counterfeiting rights and international trade on the protection of geographical indications of agricultural products. Based on the analysis of the relationship between the geographical indications of agricultural products and related concepts, this paper puts forward that the geographical indications of agricultural products have the characteristics of ownership relative publicity, production limitation, market relative monopoly, and brand effect. The paper points out that the geographical indication of agricultural products should focus on protecting the unique natural ecological environment, production mode, product quality and humanistic history. The ecological benefit, economic benefit and social benefit of agricultural product geographical indication protection are analyzed. On the basis of summing up the course of development, this paper makes a systematic analysis on the protection orientation of international agricultural products geographical indications and the protection system of agricultural products in typical countries (regions), such as the European Union, the United States, Spain, etc. The development characteristics of foreign countries and the reference to our country are put forward. This paper systematically studies the management system of "one name, two modes, three departments" of geographical indications in China, and comprehensively analyzes the legal basis, functions and registration procedures of the three departments of agriculture, industry and commerce, and quality inspection in carrying out the protection work of geographical indications. In this paper, the advantages and disadvantages of each department are compared and analyzed, and the idea and direction of perfecting the management system of agricultural products geographical indication are put forward. The paper has carried out a comprehensive survey on the geographical indication resources of agricultural products in the four major regions of China, including planting, animal husbandry, fishery, eastern, central, western and northeast China, and has made a comprehensive survey on agriculture, industry and commerce. The geographical indications of agricultural products registered by three quality inspection departments were systematically analyzed. According to the results of industry investigation, the development focus of 6 kinds of characteristic resources, such as rice, is put forward, and the advantage potential index R model is established to judge the regional or trade development focus. Based on this model, four regions and provinces are selected. This paper analyzes the development of various industries and puts forward some suggestions for the development of geographical indications of agricultural products. Through a comprehensive questionnaire survey, this paper makes a strategic analysis of government administrators, register holders, logo users, market consumers and other relevant actors of agricultural product geographical indications, and comprehensively studies industrial development, policy and system, quality control, etc. In the aspects of sign use, market promotion, consumption intention and so on, this paper deeply analyzes the existing problems and the causes, and makes a game analysis on the relevant actors such as agricultural product geographical indication production enterprises, consumers, government and so on. The equilibrium strategy is proposed. Finally, on the basis of comprehensive analysis, this paper puts forward the countermeasures and suggestions to further improve the protection of agricultural products geographical indications from three aspects: management system, technical support and service guarantee.
