【摘要】：計(jì)算機(jī)字體單字的可著作權(quán)問(wèn)題隨著"方正電子公司訴寶潔公司侵犯計(jì)算機(jī)字體‘飄柔’"案的發(fā)生,已成為知識(shí)產(chǎn)權(quán)領(lǐng)域的焦點(diǎn)話(huà)題。這一問(wèn)題的解決需要從知識(shí)產(chǎn)權(quán)法的基本原理出發(fā),對(duì)計(jì)算機(jī)字體單字可著作權(quán)問(wèn)題中涉及的諸如"獨(dú)創(chuàng)性"、"創(chuàng)造與勞動(dòng)"、"獨(dú)創(chuàng)性與審美性"、"創(chuàng)作與手段"等基本的范疇展開(kāi)進(jìn)一步的反思、質(zhì)評(píng)和考辨。計(jì)算機(jī)字體單字作為美術(shù)作品保護(hù)符合著作權(quán)的基本法理,有其邏輯上的自洽性;計(jì)算機(jī)字體單字和字庫(kù)同時(shí)受著作權(quán)保護(hù),既是形式邏輯的必然要求,也符合范式國(guó)家立法的發(fā)展潮流和正確理解立場(chǎng)。基于此,有必要借鑒相關(guān)國(guó)際公約和國(guó)外先進(jìn)立法,設(shè)計(jì)我國(guó)《著作權(quán)法》第三次修改的具體進(jìn)路,并對(duì)計(jì)算機(jī)字體單字的著作權(quán)保護(hù)作出合理的制度安排,以期為我國(guó)《著作權(quán)法》的適時(shí)完善有所裨益。
[Abstract]:With the occurrence of the case of "Fang Zheng Electronics Company v. P & G Company infringing on computer fonts", the issue of the copyright of computer fonts has become a hot topic in the field of intellectual property. The solution to this problem needs to be based on the basic principles of intellectual property law. This paper makes further reflection on the basic categories such as "originality", "creation and labor", "originality and aesthetics", "creation and means" and so on, which are involved in the copyright of computer fonts. As the protection of art works, the word of computer font accords with the basic legal principle of copyright, it has its logical self-consistency, and the character of computer font is protected by copyright at the same time, which is the inevitable requirement of formal logic. Also in line with the paradigm of the development of national legislation and a correct understanding of the position. Based on this, it is necessary to draw lessons from relevant international conventions and foreign advanced legislation, to design the specific way of the third revision of the copyright Law of our country, and to make reasonable institutional arrangements for the copyright protection of computer font words. In order to improve the copyright Law of our country at the right time.
