【摘要】：隨著我國(guó)社會(huì)經(jīng)濟(jì)和文化事業(yè)的發(fā)展以及中國(guó)當(dāng)代藝術(shù)設(shè)計(jì)興起,著作權(quán)和平面設(shè)計(jì)的發(fā)展及相互關(guān)系越來(lái)越受到廣泛的重視。平面設(shè)計(jì)在發(fā)展的進(jìn)程中,由于知識(shí)產(chǎn)權(quán)法律的缺失以及人們法律意識(shí)的淡泊等因素導(dǎo)致了侵權(quán)行為的發(fā)生,損害了著作權(quán)權(quán)利人的合法權(quán)利和經(jīng)濟(jì)利益。目前,我國(guó)對(duì)著作權(quán)和平面設(shè)計(jì)關(guān)系的研究還很薄弱,對(duì)著作權(quán)法和平面設(shè)計(jì)相互關(guān)系的研究,有助于認(rèn)識(shí)著作權(quán)法對(duì)中國(guó)當(dāng)代平面設(shè)計(jì)發(fā)展的影響以及著作權(quán)視野下中國(guó)當(dāng)代平面設(shè)計(jì)發(fā)展趨勢(shì)。 首先,通過(guò)對(duì)著作權(quán)法和中國(guó)當(dāng)代平面設(shè)計(jì)相關(guān)理論對(duì)比,梳理著作權(quán)法對(duì)于平面設(shè)計(jì)保護(hù)的發(fā)展過(guò)程。其次,論文重點(diǎn)通過(guò)著作權(quán)法對(duì)平面設(shè)計(jì)的保護(hù)和影響兩個(gè)部分,分析著作權(quán)法保護(hù)與限制的必要性以及平面設(shè)計(jì)在著作權(quán)視野下創(chuàng)意、制作、使用中的特征。具體通過(guò)世界各國(guó)對(duì)平面設(shè)計(jì)的保護(hù)以及我國(guó)通過(guò)民事保護(hù)制度、行政保護(hù)制度和刑事保護(hù)制度對(duì)平面設(shè)計(jì)的保護(hù)等幾個(gè)方面論述著作權(quán)法對(duì)平面設(shè)計(jì)的保護(hù)；通過(guò)對(duì)平面設(shè)計(jì)創(chuàng)意、制作、傳播三個(gè)方面來(lái)研究著作權(quán)法對(duì)平面設(shè)計(jì)發(fā)展的影響。最后,基于著作權(quán)法和中國(guó)當(dāng)代平面設(shè)計(jì)相關(guān)理論,以及著作權(quán)法對(duì)平面設(shè)計(jì)保護(hù)和影響的研究分析,嘗試探討著作權(quán)法促進(jìn)中國(guó)當(dāng)代平面設(shè)計(jì)的著作權(quán)視野下中國(guó)當(dāng)代平面設(shè)計(jì)向法制化、數(shù)據(jù)化、產(chǎn)業(yè)化發(fā)展的趨勢(shì)。 總的來(lái)說(shuō),著作權(quán)法對(duì)中國(guó)當(dāng)代平面設(shè)計(jì)發(fā)展的影響體現(xiàn)在各個(gè)方面,它對(duì)平面設(shè)計(jì)發(fā)展有著重要的影響。
[Abstract]:With the development of social economy and culture in China and the rise of contemporary art design in China, the development and mutual relationship between copyright and graphic design have been paid more and more attention. In the process of the development of graphic design, due to the lack of intellectual property law and the lack of legal consciousness of people, it leads to the occurrence of tort, which damages the legitimate rights and economic interests of copyright owners. At present, the research on the relationship between copyright and graphic design in China is still very weak. It is helpful to understand the influence of copyright law on the development of Chinese contemporary graphic design and the development trend of Chinese contemporary graphic design from the perspective of copyright. First of all, by comparing copyright law with relevant theories of contemporary graphic design in China, this paper combs the development process of copyright law for graphic design protection. Secondly, the thesis analyzes the necessity of copyright law protection and restriction and the characteristics of creative, production and use of graphic design in the view of copyright through the protection and influence of copyright law on graphic design. Through the protection of graphic design in the world and the protection of graphic design by civil protection system, administrative protection system and criminal protection system in our country, this paper discusses the protection of graphic design by copyright law. This paper studies the influence of copyright law on the development of graphic design through three aspects of graphic design originality, production and dissemination. Finally, based on the relevant theories of copyright law and Chinese contemporary graphic design, as well as the research and analysis of copyright law on the protection and influence of graphic design, This paper attempts to explore the trend of the development of Chinese contemporary graphic design from the perspective of copyright law to legalization, data and industrialization. In general, copyright law has an important influence on the development of graphic design in China.
