【摘要】：技術(shù)標(biāo)準(zhǔn)與專利的結(jié)合，是知識(shí)經(jīng)濟(jì)和高新技術(shù)迅猛發(fā)展的產(chǎn)物，也是當(dāng)今世界經(jīng)濟(jì)發(fā)展的必然趨勢(shì)。這不僅給企業(yè)帶來(lái)了規(guī)模經(jīng)濟(jì)效益，同時(shí)也有利于為消費(fèi)者謀福利。但是，技術(shù)標(biāo)準(zhǔn)與專利的結(jié)合在發(fā)揮其積極效用的同時(shí)也容易產(chǎn)生專利權(quán)的濫用，，包括標(biāo)準(zhǔn)制定過(guò)程中違反專利信息披露義務(wù)、專利拒絕許可、歧視性待遇等。并且此類專利權(quán)濫用行為由于標(biāo)準(zhǔn)所固有的公共性和強(qiáng)制性等特征而更具殺傷力。當(dāng)前發(fā)達(dá)國(guó)家優(yōu)勢(shì)企業(yè)為獲取最大利益，制定并施行“技術(shù)專利化，專利標(biāo)準(zhǔn)化，標(biāo)準(zhǔn)國(guó)際化”的標(biāo)準(zhǔn)化戰(zhàn)略，更使得專利與標(biāo)準(zhǔn)的結(jié)合實(shí)質(zhì)成為隱形的貿(mào)易壁壘，對(duì)國(guó)內(nèi)企業(yè)的正當(dāng)利益、技術(shù)創(chuàng)新秩序、有效競(jìng)爭(zhēng)秩序造成很大的損害和威脅。我國(guó)目前雖已出臺(tái)《反壟斷法》，但其中對(duì)于知識(shí)產(chǎn)權(quán)的反壟斷規(guī)定過(guò)于籠統(tǒng)。本文從技術(shù)標(biāo)準(zhǔn)與專利權(quán)的含義和制度價(jià)值出發(fā)，分析二者結(jié)合的必然性，介紹技術(shù)標(biāo)準(zhǔn)下專利權(quán)濫用行為的具體表現(xiàn)形式，通過(guò)分析借鑒美國(guó)、歐盟、日本對(duì)技術(shù)標(biāo)準(zhǔn)中專利權(quán)濫用行為的反壟斷規(guī)制現(xiàn)狀，建議對(duì)技術(shù)標(biāo)準(zhǔn)壟斷采用合理性原則為主、本身違法原則為輔的分析原則，同時(shí)制定知識(shí)產(chǎn)權(quán)領(lǐng)域的反壟斷法指南并完善反壟斷規(guī)制的運(yùn)行機(jī)制。
[Abstract]:The combination of technical standards and patents is the product of the rapid development of knowledge economy and high technology, and is also the inevitable trend of economic development in the world today. This not only brings economies of scale to enterprises, but also benefits consumers. However, the combination of technical standards and patents is prone to abuse of patent rights while exerting its positive effect, including violation of the obligation of patent information disclosure in the process of standard making, refusal of patent license, discriminatory treatment and so on. Moreover, this kind of patent abuse is more harmful because of the characteristic of publicity and compulsion inherent in the standard. At present, in order to obtain the maximum benefit, the advantage enterprises of developed countries formulate and implement the standardization strategy of "technology patenting, patent standardization, standard internationalization", which makes the combination of patent and standard become an invisible trade barrier in essence. It causes great damage and threat to the legitimate interests of domestic enterprises, the order of technological innovation and the order of effective competition. Although our country has issued Antimonopoly Law, the anti-monopoly regulation of intellectual property is too general. Starting from the meaning and institutional value of technical standard and patent right, this paper analyzes the inevitability of combining them, introduces the concrete forms of patent abuse under technical standard, and draws lessons from the United States and European Union. Japan's anti-monopoly regulation of patent abuse in technical standards suggests that the principle of rationality should be applied to the monopoly of technical standards, supplemented by the principle of illegality. At the same time, it formulates the guide of anti-monopoly law in the field of intellectual property and consummates the operating mechanism of anti-monopoly regulation.
