商業(yè)標(biāo)識保護(hù)法律體系研究

【摘要】:隨著經(jīng)濟(jì)的飛速發(fā)展和科技的日新月異,知識產(chǎn)權(quán)在市場經(jīng)濟(jì)和社會生活中的作用日益突出,,國際社會各個國家對知識產(chǎn)權(quán)也越來越重視,均相繼構(gòu)建和完善了知識產(chǎn)權(quán)方面的法律保護(hù)制度。而知識產(chǎn)權(quán)具體到商業(yè)標(biāo)識領(lǐng)域,其內(nèi)涵越來越豐富,除商標(biāo)、企業(yè)名稱外,域名、商業(yè)外觀、地理標(biāo)志、知名商品的名稱包裝裝潢、特殊標(biāo)志等各類商業(yè)標(biāo)識也大量涌現(xiàn),同時,正確認(rèn)識各類商業(yè)標(biāo)識在經(jīng)濟(jì)領(lǐng)域中的價值,對于我國綜合國力的提升以及建設(shè)創(chuàng)新型國家都具有重要的意義。因此,為了保護(hù)新出現(xiàn)的商業(yè)標(biāo)識,解決商業(yè)標(biāo)識法律保護(hù)的各種問題,最大限度的整合資源,促進(jìn)經(jīng)濟(jì)社會健康快速發(fā)展,本文將商業(yè)標(biāo)識作為一個整體進(jìn)行研究。 本文首先從商業(yè)標(biāo)識保護(hù)方面的典型案例出發(fā),引出商業(yè)標(biāo)識的基本概念、種類、功能和價值,從而為后文的論述奠定理論基礎(chǔ),使讀者對其有了直觀的認(rèn)識。第二部分指出我國商業(yè)標(biāo)識法律體系立法規(guī)范的混亂龐雜、執(zhí)法司法標(biāo)準(zhǔn)不統(tǒng)一等現(xiàn)狀和弊端,然后引出了我國商業(yè)標(biāo)識保護(hù)法律體系的不完善導(dǎo)致的權(quán)利沖突等問題,同時借鑒和參考發(fā)達(dá)國家的經(jīng)驗,結(jié)合中國國情,最后提出解決商業(yè)標(biāo)保護(hù)法律體系問題的建議和意見。 總之,筆者希望通過本文對于商業(yè)標(biāo)識保護(hù)法律體系的研究,立足于法律所處的社會環(huán)境,分析出我國商業(yè)標(biāo)識法律保護(hù)的現(xiàn)狀,進(jìn)而探索造成商業(yè)標(biāo)識立法缺失、權(quán)利沖突及侵權(quán)等現(xiàn)象背后的原因,得出構(gòu)建和完善我國商業(yè)標(biāo)識保護(hù)法律體系的結(jié)論,并就一些問題的解決提出了建議和意見。
[Abstract]:With the rapid development of economy and the rapid development of science and technology, intellectual property rights play an increasingly prominent role in market economy and social life, and all countries in the international community attach more and more importance to intellectual property rights. The legal protection system of intellectual property rights has been constructed and perfected one after another. The intellectual property rights are more and more rich in the field of commercial logos. In addition to trademarks, enterprise names, domain names, commercial appearance, geographical indications, the names, packaging and decoration of well-known commodities, special marks, and so on, various kinds of commercial logos have also emerged in large numbers. At the same time, it is of great significance to correctly understand the value of various commercial logos in the economic field for the promotion of our country's comprehensive national strength and the construction of an innovative country. Therefore, in order to protect the emerging business logo, solve the various problems of legal protection, maximize the integration of resources, and promote the rapid development of economic and social health, this paper studies commercial logo as a whole. In this paper, the basic concept, category, function and value of the commercial logo are introduced from the typical cases of the protection of the commercial logo, which lays a theoretical foundation for the later discussion and makes the reader have an intuitive understanding of it. The second part points out the current situation and malpractice of the legal system of commercial logo in our country, such as the confusion of legislation and regulation of the legal system of commercial logo, the disunity of the judicial standard of law enforcement, and so on, and then leads to the conflict of rights caused by the imperfection of the legal system of business marking protection in our country. At the same time, we draw lessons from the experience of developed countries and combine with the national conditions of China, and finally put forward some suggestions and suggestions to solve the problem of the legal system of commercial standard protection. In a word, the author hopes that through the study of the legal system of the protection of commercial marking in this paper, based on the social environment in which the law is located, the author will analyze the current situation of the legal protection of commercial marking in our country, and then explore the lack of legislation on commercial marking. Based on the reasons behind the conflict of rights and infringement, this paper draws a conclusion of constructing and perfecting the legal system for the protection of commercial logos in China, and puts forward some suggestions and suggestions on how to solve some problems.
