【摘要】：本文的主要目的是探討，實(shí)用藝術(shù)作品與外觀設(shè)計(jì)的區(qū)分問題。 伯爾尼公約對(duì)實(shí)用藝術(shù)作品給予保護(hù)做出規(guī)定，但具體的保護(hù)模式并未做統(tǒng)一規(guī)定，外觀設(shè)計(jì)也是國際法中明確保護(hù)的客體。但各國法律規(guī)定并不相同。隨著2013年著作權(quán)法修改草案的提出，我國形成了著作權(quán)法保護(hù)實(shí)用藝術(shù)作品、專利法保護(hù)外觀設(shè)計(jì)的局面。但是，實(shí)用藝術(shù)作品與外觀設(shè)計(jì)之間有很多重疊之處。這種保護(hù)方式存在缺陷。 本文主要是通過分析實(shí)用藝術(shù)作品與外觀設(shè)計(jì)在客體、內(nèi)容、公共利益政策三個(gè)方面的重疊與沖突，提出區(qū)分兩者的必要性與合理性，并指出從客體的角度、內(nèi)容的角度、公共政策的角度區(qū)分兩者的可行性。最后指出我國現(xiàn)在對(duì)兩者保護(hù)的缺陷，，并探討著作權(quán)法修改中應(yīng)如何協(xié)調(diào)兩者的保護(hù)。
[Abstract]:The main purpose of this paper is to discuss the distinction between practical works of art and design. The Berne Convention provides for the protection of practical works of art, but the specific protection model is not uniform, and the design is also the object of explicit protection in international law. But national laws and regulations are not the same. With the proposal of the revised draft of copyright Law in 2013, the situation of copyright law protecting practical works of art and patent law protecting appearance design has been formed in China. But there is a lot of overlap between a practical work of art and a design. This method of protection is flawed. By analyzing the overlap and conflict between practical art works and appearance design in object, content and public interest policy, this paper puts forward the necessity and rationality of distinguishing them, and points out the angle of object and content. The perspective of public policy distinguishes the feasibility of the two. Finally, this paper points out the defects of the protection of both in our country, and probes into how to coordinate the protection between the two in the revision of copyright law.
