【摘要】：知識產(chǎn)權(quán)全球保護已經(jīng)成為當(dāng)今世界國際經(jīng)濟、科技、文化以及貿(mào)易交往中一種重要的法律秩序,而《TRIPS協(xié)議》就是知識產(chǎn)權(quán)全球保護的最直接成果與法律依據(jù)。在經(jīng)濟全球化的發(fā)展趨勢下,知識產(chǎn)權(quán)越來越與國際貿(mào)易交織在一起,呈現(xiàn)出新的發(fā)展特征,并且知識產(chǎn)權(quán)已經(jīng)成為國家經(jīng)濟利益構(gòu)成中重要的一個組成部分。知識產(chǎn)權(quán)全球保護具有地域性的特征,這一點是難以消除的,在知識產(chǎn)權(quán)的全球保護中,必須要遵循最惠國待遇原則、國民待遇原則、透明化原則等。但是,隨著當(dāng)前經(jīng)濟的發(fā)展以及科學(xué)技術(shù)的發(fā)展,再次對知識產(chǎn)權(quán)全球保護問題提出了新的可供遵循的原則,比如消除弱國與強國之間的發(fā)展差距以及尊重人權(quán)原則等。本研究正是基于以上考慮,從對知識產(chǎn)權(quán)全球保護的現(xiàn)狀,特別是對《TRI PS協(xié)議》的研究出發(fā),分析了當(dāng)前知識產(chǎn)權(quán)全球保護的相關(guān)理論問題以及發(fā)展現(xiàn)狀、存在的不足等現(xiàn)實問題,并提出知識產(chǎn)權(quán)全球保護的視野下,中國的應(yīng)對策略。
[Abstract]:The global protection of intellectual property rights has become an important legal order in the international economy, technology, culture and trade exchanges in the world today, and the TRIPS Agreement is the most direct achievement and legal basis for the global protection of intellectual property rights. Under the development trend of economic globalization, intellectual property rights are more and more intertwined with international trade, showing new development characteristics, and intellectual property rights have become an important part of national economic interests. The global protection of intellectual property rights has regional characteristics, which is difficult to eliminate. In the global protection of intellectual property rights, the principle of most-favoured-nation treatment, the principle of national treatment and the principle of transparency must be followed in the global protection of intellectual property rights. However, with the current economic development and the development of science and technology, new principles for the global protection of intellectual property rights have been put forward, such as eliminating the development gap between weak and powerful countries and respecting human rights. This study is based on the above considerations, from the current situation of the global protection of intellectual property, especially the "TRI PS Agreement", analyzed the current intellectual property rights of the relevant theoretical issues and the development of global protection. And put forward the countermeasures of China under the vision of global protection of intellectual property.
