我國文化產(chǎn)業(yè)立法研究

【摘要】:隨著2009年7月5《文化產(chǎn)業(yè)振興規(guī)劃》的公布,文化產(chǎn)業(yè)已經(jīng)上升為國家戰(zhàn)略性產(chǎn)業(yè)。文化產(chǎn)業(yè)立法是文化產(chǎn)業(yè)發(fā)展到一定階段的必然要求。我國文化產(chǎn)業(yè)的發(fā)展起步較晚,但是近年來,國家開始重視文化產(chǎn)業(yè),在財(cái)政、稅收等方面都出臺(tái)了相關(guān)政策,大力支持文化產(chǎn)業(yè)的發(fā)展。從整體上來看,我國文化產(chǎn)業(yè)發(fā)展也呈現(xiàn)出蒸蒸日上的態(tài)勢。但是,,目前我國文化產(chǎn)業(yè)的立法層次太低,立法過于滯后,文化產(chǎn)業(yè)法律交叉重復(fù)、法律體系健全,造成了文化產(chǎn)業(yè)管理混亂、市場秩序不規(guī)范、文化企業(yè)稅負(fù)過重、知識(shí)產(chǎn)權(quán)缺乏有效保護(hù)等問題的存在。對文化產(chǎn)業(yè)的規(guī)范管理,不是停留在簡單的幾部法律層面上,而是要進(jìn)一步完善文化產(chǎn)業(yè)法律體系,為整個(gè)行業(yè)的發(fā)展提供全方位保護(hù)。為了實(shí)施國家文化產(chǎn)業(yè)發(fā)展戰(zhàn)略,推動(dòng)文化產(chǎn)業(yè)迅速崛起,我國急需制定文化產(chǎn)業(yè)基本法,推進(jìn)文化體制改革,建立和完善文化產(chǎn)業(yè)發(fā)展的相關(guān)法律制度。 研究發(fā)現(xiàn),國外在文化產(chǎn)業(yè)發(fā)展過程中,政府通過立法確定文化產(chǎn)業(yè)市場運(yùn)作機(jī)制、產(chǎn)業(yè)政策扶持、推動(dòng)傳統(tǒng)文化傳播等經(jīng)驗(yàn)值得我國學(xué)習(xí)和借鑒。我國文化產(chǎn)業(yè)立法要在提高層次、適度超前和與其他法律協(xié)調(diào)的原則下,符合文化產(chǎn)業(yè)自身發(fā)展的特征,注重保護(hù)知識(shí)產(chǎn)權(quán)和傳承、發(fā)揚(yáng)民族文化。可以將“文化產(chǎn)業(yè)”寫入憲法,通過制定專門的文化產(chǎn)業(yè)基本法,梳理文化產(chǎn)業(yè)管理規(guī)范性立法,完善文化產(chǎn)業(yè)保護(hù)促進(jìn)性立法,鼓勵(lì)地方文化產(chǎn)業(yè)探索性立法,從多方面完善文化產(chǎn)業(yè)法律體系,使文化產(chǎn)業(yè)法律體系更加符合時(shí)代所需,為文化產(chǎn)業(yè)的發(fā)展保駕護(hù)航。
[Abstract]:With the publication of the Plan for the Revitalization of Cultural Industry on July 5, 2009, cultural industry has become a national strategic industry. The legislation of cultural industry is an inevitable requirement for the development of cultural industry to a certain stage. The development of the cultural industry in our country started late, but in recent years, the country began to attach importance to the cultural industry, in the financial, tax and other aspects of the introduction of relevant policies, vigorously support the development of cultural industry. On the whole, the development of China's cultural industry is also showing a growing trend. However, at present, the legislative level of cultural industry in China is too low, the legislation is too lagged behind, the law of cultural industry is overlapping and duplicating, and the legal system is perfect, which has resulted in confusion in the management of cultural industry, non-standard market order, and excessive tax burden on cultural enterprises. Lack of effective protection of intellectual property rights and other problems. The standard management of the cultural industry is not to stay on the simple legal level, but to further improve the legal system of the cultural industry, to provide all-round protection for the development of the whole industry. In order to implement the development strategy of national cultural industry and promote the rapid rise of cultural industry, it is urgent for our country to formulate the basic law of cultural industry, promote the reform of cultural system, and establish and perfect the relevant legal system for the development of cultural industry. It is found that in the process of cultural industry development in foreign countries, the government should adopt legislation to determine the market operation mechanism of cultural industry, support industrial policy, and promote the spread of traditional culture, and so on, which are worthy of our country to learn and learn from. Under the principle of raising the level, moderately leading and coordinating with other laws, the legislation of our cultural industry should accord with the characteristics of the development of the cultural industry itself, pay attention to the protection of intellectual property rights and inheritance, and carry forward the national culture. "Cultural industry" can be written into the Constitution, through the formulation of a special basic law on cultural industry, sorting out the normative legislation on the management of cultural industry, perfecting the promoting legislation on the protection of cultural industry, and encouraging exploratory legislation of local cultural industry. To perfect the legal system of cultural industry from many aspects, to make the legal system of cultural industry more in line with the needs of the times, and to protect the development of cultural industry.
