【摘要】：從1958年集成電路問世至今,集成電路技術(shù)的不斷提高促進(jìn)了電子信息業(yè)的快速發(fā)展,人類的生活也因此發(fā)生了巨大的變化,集成電路產(chǎn)業(yè)逐漸成為信息化時代的全球先導(dǎo)性產(chǎn)業(yè),21世紀(jì)世界各國都將集成電路產(chǎn)業(yè)作為重點戰(zhàn)略產(chǎn)業(yè)來發(fā)展和扶持。作為集成電路產(chǎn)業(yè)的核心,集成電路布圖設(shè)計被侵權(quán)現(xiàn)象的日益嚴(yán)重促使各國紛紛立法對其進(jìn)行保護(hù)。在2001年,國務(wù)院通過了《集成電路布圖設(shè)計保護(hù)條例》,但是經(jīng)過十幾年的實踐,在對集成電路布圖設(shè)計的保護(hù)中也暴露了不少問題,為此,本文將對我國的立法和國際公約以及國外立法進(jìn)行比較,并對集成電路布圖設(shè)計法律保護(hù)存在的問題進(jìn)行分析和討論,希望會對我國集成電路布圖設(shè)計的法律保護(hù)理論研究提供綿薄之力。 本文分為五個章節(jié),第一章節(jié)對集成電路和集成電路布圖設(shè)計的概念和內(nèi)涵進(jìn)行了區(qū)分,明確二者的區(qū)別,即在對集成電路的研究制造過程中,其核心的步驟在于完成集成電路布圖設(shè)計,集成電路布圖設(shè)計的好壞決定集成電路研制的成敗,所以應(yīng)該通過保護(hù)集成電路布圖設(shè)計來達(dá)到保護(hù)集成電路的目的,又闡述了集成電路布圖設(shè)計的技術(shù)特征和法律特征。第二章節(jié)結(jié)合了美國集成電路產(chǎn)業(yè)的發(fā)展論證了保護(hù)集成電路布圖設(shè)計的必要性,并對集成電路布圖設(shè)計保護(hù)模式進(jìn)行探討,得出結(jié)論,采用專利法、版權(quán)法和商業(yè)秘密等傳統(tǒng)知識產(chǎn)權(quán)立法都不足以對集成電路布圖設(shè)計進(jìn)行有效的保護(hù),應(yīng)該采取專門立法。第三章節(jié)簡要的介紹了世界各國對于保護(hù)集成電路布圖設(shè)計的專門立法和國際條約。并對各國立法和國際條約進(jìn)行了評價,闡述了國際公約及外國立法對我國立法的借鑒意義。第四章節(jié)介紹了我國現(xiàn)有立法《集成電路布圖設(shè)計保護(hù)條例》,闡述了集成電路布圖設(shè)計專有權(quán)的權(quán)利主體、權(quán)利的客體及權(quán)利的取得及保護(hù)期限等,重點對集成電路布圖設(shè)計的保護(hù)條件之一創(chuàng)造性進(jìn)行了探討,得出結(jié)論集成電路布圖設(shè)計所具備的創(chuàng)造性低于專利法中規(guī)定的創(chuàng)造性并高于版權(quán)法中規(guī)定的創(chuàng)造性。第五章節(jié)提出了我國現(xiàn)有立法《集成電路布圖設(shè)計保護(hù)條例》存在的問題,并就上述問題提出自己的完善建議。
[Abstract]:Since the advent of integrated circuits in 1958, the continuous improvement of integrated circuit technology has promoted the rapid development of the electronic information industry, and human life has therefore undergone tremendous changes. The integrated circuit industry has gradually become the global leading industry in the information age. In the 21st century, countries all over the world take the integrated circuit industry as the key strategic industry to develop and support. As the core of integrated circuit industry, the infringement of integrated circuit layout design is becoming more and more serious. In 2001, the State Council passed the regulations on the Protection of Integrated Circuit layout Design. However, after more than 10 years of practice, many problems have been exposed in the protection of integrated circuit layout design. This paper compares the legislation of our country with international conventions and foreign legislations, and analyzes and discusses the problems existing in the legal protection of integrated circuit layout design. It is hoped that the research on the legal protection theory of integrated circuit layout design in China will be limited. This paper is divided into five chapters. In the first chapter, the concept and connotation of integrated circuit and integrated circuit layout design are distinguished, and the difference between them is made clear, that is, in the process of research and manufacture of integrated circuit, Its core step is to complete the integrated circuit layout design, the quality of the integrated circuit layout design determines the success or failure of the integrated circuit development, so we should protect the integrated circuit layout design to achieve the purpose of protecting the integrated circuit. The technical and legal features of integrated circuit layout design are also expounded. In the second chapter, the necessity of layout design of integrated circuit protection is demonstrated in combination with the development of the integrated circuit industry in the United States, and the protection mode of layout design of integrated circuit is discussed, and the conclusion is drawn that the patent method is adopted. Traditional intellectual property legislation, such as copyright law and trade secret, is not enough to protect integrated circuit layout design effectively, so special legislation should be adopted. The third chapter briefly introduces the special legislation and international treaties for the protection of integrated circuit layout design in the world. It also evaluates the legislation and treaties of various countries, and expounds the significance of international conventions and foreign legislations to the legislation of our country. The fourth chapter introduces the existing legislation of our country, the regulations on the layout Design of Integrated Circuits, and expounds the subject of the right, the object of the right, the acquisition of the right and the time limit of the protection, etc, of the exclusive right of the layout design of the integrated circuit. It is concluded that the creativity of integrated circuit layout design is lower than that of patent law and is higher than that of copyright law. In the fifth chapter, the author puts forward the problems existing in the existing legislation of our country, and puts forward some suggestions on the improvement of the above problems.
