【摘要】：專(zhuān)家證人制度雖然是民事訴訟法中的內(nèi)容，但是作為與民法一脈相通的知識(shí)產(chǎn)權(quán)法中也經(jīng)常對(duì)其有所涉及，在科學(xué)技術(shù)不斷發(fā)展的今天，知識(shí)產(chǎn)權(quán)案件經(jīng)常涉及一些專(zhuān)業(yè)領(lǐng)域的技術(shù)問(wèn)題，在此背景之下,為解決訴訟中的技術(shù)問(wèn)題而產(chǎn)生的專(zhuān)家證人制度開(kāi)始受到我國(guó)知識(shí)產(chǎn)權(quán)理論界與實(shí)務(wù)界的關(guān)注。我國(guó)現(xiàn)在在民事訴訟法以及知識(shí)產(chǎn)權(quán)訴訟中都還沒(méi)有有關(guān)專(zhuān)家證人制度的立法，但是在我國(guó)知識(shí)產(chǎn)權(quán)訴訟司法實(shí)踐中已經(jīng)出現(xiàn)了對(duì)專(zhuān)家證人制度的適用，例如一些法院已經(jīng)在知識(shí)產(chǎn)權(quán)訴訟中使用專(zhuān)家證人以及出臺(tái)了一些改革措施來(lái)推行專(zhuān)家證人制度，雖然目前看來(lái)這些措施在知識(shí)產(chǎn)權(quán)訴訟中收到了不錯(cuò)的效果，給知識(shí)產(chǎn)權(quán)案件帶來(lái)了一些利益，但長(zhǎng)此下去，，必然會(huì)因?yàn)樵撝贫热狈σ?guī)定性及操作性而產(chǎn)生一系列的問(wèn)題，我的論文就是針對(duì)這種情況，提出將專(zhuān)家證人制度引入我國(guó)知識(shí)產(chǎn)權(quán)訴訟的設(shè)想，但我同時(shí)也看到，專(zhuān)家證人制度是英美法系的產(chǎn)物，因此在引進(jìn)該制度的過(guò)程中我們應(yīng)當(dāng)對(duì)其有所保留，并且我國(guó)的鑒定人制度也存在專(zhuān)家證人制度不可替代的優(yōu)點(diǎn)，于是我設(shè)想將專(zhuān)家證人制度與鑒定人制度結(jié)合起來(lái)，形成專(zhuān)家——鑒定人模式，并在文章中提出了對(duì)我國(guó)知識(shí)產(chǎn)權(quán)訴訟中專(zhuān)家證人制度的立法構(gòu)建的設(shè)想。
[Abstract]:Although the expert witness system is the content of the civil procedure law, it is often involved in the intellectual property law, which is connected with the civil law. Today, with the development of science and technology, Intellectual property rights cases often involve some technical problems in professional fields. Under this background, the expert witness system in order to solve the technical problems in litigation has attracted the attention of intellectual property theorists and practitioners in our country. There is no legislation on the expert witness system in the civil procedure law and intellectual property litigation in our country, but in the judicial practice of intellectual property litigation in our country, the expert witness system has been applied. For example, some courts have used expert witnesses in intellectual property litigation and introduced some reform measures to implement the expert witness system, although it appears that these measures have achieved good results in intellectual property litigation. It has brought some benefits to intellectual property cases, but in the long run, it will inevitably cause a series of problems due to the lack of regulation and operation of the system. My paper aims at this kind of situation. This paper puts forward the idea of introducing the expert witness system into our intellectual property litigation, but at the same time, I also see that the expert witness system is the product of the common law system, so we should have some reservations about it in the process of introducing this system. And the expert witness system in our country also has the irreplaceable advantages of the expert witness system, so I imagine combining the expert witness system with the expert witness system to form the expert-expert model. In this paper, the author puts forward some ideas on the legislative construction of expert witness system in intellectual property litigation in China.
