【摘要】:保險(xiǎn)產(chǎn)品是保險(xiǎn)行業(yè)賴以發(fā)展的核心要素。目前學(xué)界對(duì)保險(xiǎn)產(chǎn)品內(nèi)涵的界定尚無統(tǒng)一定論,主要有“無形服務(wù)商品論”、“消費(fèi)者補(bǔ)償論”、“金融衍生品論”和“產(chǎn)品層次論”四種觀點(diǎn)。結(jié)合學(xué)界理論和保險(xiǎn)實(shí)務(wù),保險(xiǎn)產(chǎn)品是保險(xiǎn)公司為市場(chǎng)提供的有形產(chǎn)品和無形服務(wù)的綜合體,,具體可以從核心產(chǎn)品維度、形式產(chǎn)品維度和拓展產(chǎn)品維度三個(gè)維度理解保險(xiǎn)產(chǎn)品的整體內(nèi)涵。與其他產(chǎn)品相比,保險(xiǎn)產(chǎn)品具有四個(gè)特殊屬性,即保險(xiǎn)產(chǎn)品是特殊而復(fù)雜的商品,是抽象的無形商品,是非渴求性的消費(fèi)品,是具有較強(qiáng)異質(zhì)性的商品。 保險(xiǎn)產(chǎn)品的創(chuàng)新與開發(fā)是個(gè)復(fù)雜的系統(tǒng)工程。開發(fā)一款新型產(chǎn)品,保險(xiǎn)公司要遵循合法性、市場(chǎng)性、效益性、標(biāo)準(zhǔn)化等原則,要經(jīng)過市場(chǎng)調(diào)研、產(chǎn)生創(chuàng)意方案、對(duì)創(chuàng)意方案進(jìn)行綜合評(píng)估、進(jìn)行產(chǎn)品的技術(shù)設(shè)計(jì)和產(chǎn)品報(bào)備審批等諸多環(huán)節(jié),付出諸多的創(chuàng)造性智力勞動(dòng)。因此,作為一種具有社會(huì)性、公開性、創(chuàng)造性和非物質(zhì)性的知識(shí)產(chǎn)品,保險(xiǎn)產(chǎn)品應(yīng)當(dāng)屬于知識(shí)產(chǎn)權(quán)的客體之一,理應(yīng)受到法律保護(hù)。從理論探討的角度看,公平正義原理、勞動(dòng)財(cái)產(chǎn)權(quán)理論、激勵(lì)理論和公共產(chǎn)品理論都能為保險(xiǎn)產(chǎn)品這項(xiàng)創(chuàng)造性智力勞動(dòng)成果的知識(shí)產(chǎn)權(quán)保護(hù)提供理論支撐。 目前,我國保險(xiǎn)產(chǎn)品的知識(shí)產(chǎn)權(quán)保護(hù)幾乎是空白,使得保險(xiǎn)同質(zhì)化同構(gòu)化嚴(yán)重。因此,加強(qiáng)保險(xiǎn)產(chǎn)品知識(shí)產(chǎn)權(quán)保護(hù)是非常有必要的,對(duì)保險(xiǎn)公司和保險(xiǎn)行業(yè)都有重要的現(xiàn)實(shí)意義。在我國現(xiàn)行法律框架下,保險(xiǎn)產(chǎn)品的知識(shí)產(chǎn)權(quán)可以受到《著作權(quán)法》、《專利法》、《商標(biāo)法》、《反不正當(dāng)競(jìng)爭法》等法律保護(hù)。在著作權(quán)保護(hù)模式下,因受思想與表達(dá)二分法原則和獨(dú)創(chuàng)性原則的限制,保險(xiǎn)產(chǎn)品著作權(quán)保護(hù)存在一定不足,但仍可以進(jìn)行積極的制度構(gòu)建予以彌補(bǔ),具體包括明確保險(xiǎn)產(chǎn)品是法定作品、明確保險(xiǎn)產(chǎn)品著作權(quán)的內(nèi)容、明確保險(xiǎn)產(chǎn)品著作權(quán)保護(hù)主體及其職責(zé)、合理設(shè)置保險(xiǎn)產(chǎn)品著作權(quán)保護(hù)期限、明確保險(xiǎn)產(chǎn)品著作權(quán)侵權(quán)行為認(rèn)定標(biāo)準(zhǔn)、制定保險(xiǎn)產(chǎn)品著作權(quán)登記規(guī)范。在專利保護(hù)模式下,對(duì)保險(xiǎn)產(chǎn)品主要是以商業(yè)方法專利形式予以保護(hù),但目前我國對(duì)保險(xiǎn)產(chǎn)品商業(yè)方法專利的保護(hù)持謹(jǐn)慎嚴(yán)格的態(tài)度。新形勢(shì)下我國應(yīng)積極構(gòu)建適合我國國情的商業(yè)方法專利保護(hù)制度,同時(shí)中資保險(xiǎn)公司也應(yīng)加強(qiáng)保險(xiǎn)產(chǎn)品商業(yè)方法的保護(hù)。另外,商標(biāo)保護(hù)模式和商業(yè)秘密保護(hù)模式也是保險(xiǎn)產(chǎn)品知識(shí)產(chǎn)權(quán)保護(hù)方式的有益補(bǔ)充。
[Abstract]:Insurance products are the core elements of the development of the insurance industry. At present, there is no unified definition of the connotation of insurance products in academic circles. There are mainly four viewpoints: "Intangible Service Commodity", "Consumer compensation", "Financial Derivatives" and "Product hierarchy". Combined with academic theory and insurance practice, insurance products are a combination of tangible products and intangible services provided by insurance companies for the market. Form product dimension and expand product dimension three dimensions to understand the overall connotation of insurance products. Compared with other products, insurance products have four special properties, that is, insurance products are special and complex commodities, abstract intangible goods, non-desirable consumer goods, and strongly heterogeneous goods. The innovation and development of insurance products is a complex system engineering. To develop a new type of product, insurance companies should abide by the principles of legitimacy, marketability, efficiency, standardization, and so on. After market research, they should produce creative plans and conduct a comprehensive evaluation of creative schemes. Carry on the technical design of the product and the examination and approval of the product report, and pay a lot of creative intellectual labor. Therefore, as a kind of knowledge product with sociality, openness, creativity and immateriality, insurance products should belong to one of the objects of intellectual property rights and should be protected by law. From the theoretical point of view, the principle of fairness and justice, the theory of labor property rights, the theory of incentive and the theory of public goods can provide theoretical support for the intellectual property protection of the creative intellectual labor achievement of insurance products. At present, the intellectual property protection of insurance products in our country is almost blank, which makes the insurance homogenization and isomorphism serious. Therefore, it is necessary to strengthen the intellectual property protection of insurance products, which is of great practical significance to insurance companies and insurance industry. Under the current legal framework of our country, the intellectual property rights of insurance products can be protected by such laws as copyright Law, Patent Law, Trademark Law, Anti-unfair Competition Law and so on. In the mode of copyright protection, due to the limitation of the dichotomy of thought and expression and the principle of originality, the protection of the copyright of insurance products has some shortcomings, but it can still be compensated by the positive system construction. Specifically, it includes making clear that the insurance product is a legal work, clarifying the content of the copyright of the insurance product, clarifying the subject of the copyright protection of the insurance product and its responsibilities, and setting up a reasonable period for the protection of the copyright of the insurance product. Define the standards of copyright infringement of insurance products and establish the registration standard of copyright of insurance products. In the mode of patent protection, insurance products are mainly protected in the form of commercial method patents, but at present our country has a cautious and strict attitude towards the protection of business method patents of insurance products. Under the new situation, our country should actively construct the patent protection system of commercial methods suitable for the national conditions of our country, and at the same time, the Chinese insurance companies should also strengthen the protection of the commercial methods of insurance products. In addition, trademark protection mode and trade secret protection mode are also a beneficial supplement to intellectual property protection of insurance products.
