【摘要】：《當(dāng)代西方知識(shí)產(chǎn)權(quán)理論的哲學(xué)反思》一書圍繞知識(shí)產(chǎn)權(quán)正當(dāng)性這一命題展開,對(duì)當(dāng)代西方知識(shí)產(chǎn)權(quán)理論進(jìn)行了批判性反思。知識(shí)產(chǎn)權(quán)的正當(dāng)性是知識(shí)產(chǎn)權(quán)法的基本問題之一,對(duì)于該問題的研究和爭論,從知識(shí)產(chǎn)權(quán)法誕生以來就沒有中斷過。及至當(dāng)代,西方學(xué)界形成了四種研究路徑,分別是:功利論、勞動(dòng)論、人格論和社會(huì)規(guī)劃論。本文在閱讀完本書后對(duì)知識(shí)產(chǎn)權(quán)的正當(dāng)性理論進(jìn)行了再思考,認(rèn)為對(duì)該命題的反思有助于分析中國知識(shí)產(chǎn)權(quán)保護(hù)的實(shí)踐選擇問題。
[Abstract]:Philosophical Reflections on the Theory of intellectual property Rights in Contemporary Western countries, a book focuses on the proposition of the legitimacy of intellectual property rights and makes a critical reflection on the theories of intellectual property rights in contemporary western countries. The legitimacy of intellectual property is one of the basic problems in intellectual property law. To the present, the western academic circles have formed four kinds of research paths, namely: utilitarianism, labor theory, personality theory and social planning theory. After reading this book, this paper rethinks the theory of the legitimacy of intellectual property, and thinks that the reflection on this proposition is helpful to analyze the practical choice of intellectual property protection in China.
