【摘要】：面對著作權(quán)保護(hù)擴(kuò)張之趨勢,如何明確保護(hù)與不保護(hù)之界限,一直是國內(nèi)外學(xué)術(shù)界長期探討的重要問題。思想與表達(dá)二分法原則被認(rèn)為是目前為止能夠解決該問題的最佳基本原則。然而,該原則難以對著作權(quán)的具體保護(hù)范圍劃出明確界限,存在一定語義含混。尤其是思想一詞難以界定,給立法和司法實(shí)踐帶來一定困難。近年來,我國著作權(quán)保護(hù)范圍的擴(kuò)張趨勢日益明顯。同時(shí),在世界知識產(chǎn)權(quán)競爭中處于明顯弱勢的情形,也要求我國結(jié)合國內(nèi)經(jīng)濟(jì)文化發(fā)展水平及文化產(chǎn)業(yè)、知識產(chǎn)權(quán)保護(hù)現(xiàn)狀及需求,積極吸納思想與表達(dá)二分法原則,以對知識產(chǎn)權(quán)中的私有領(lǐng)域和公有領(lǐng)域做出明確界定,更要結(jié)合本國實(shí)際在立法和司法實(shí)踐中將思想與表達(dá)在靈活合并的基礎(chǔ)上探討其具體的適用方式和范圍。
[Abstract]:In the face of the trend of copyright protection expansion, how to define the limits of protection and non-protection has been an important issue in academic circles at home and abroad for a long time. The principle of dichotomy of thought and expression is considered to be the best basic principle to solve the problem so far. However, it is difficult for this principle to draw a clear limit to the specific scope of copyright protection, and there is a certain semantic ambiguity. In particular, the term thought is difficult to define, which brings some difficulties to legislation and judicial practice. In recent years, the expansion trend of copyright protection scope in China is becoming more and more obvious. At the same time, the obvious weakness in the competition for intellectual property rights in the world also requires China to actively absorb the principle of dichotomy of thought and expression in the light of the level of domestic economic and cultural development and cultural industries, and the current situation and needs of intellectual property protection. In order to clearly define the private domain and the public domain in intellectual property rights, we should combine the practice of our country in legislation and judicial practice to discuss the concrete application way and scope of thinking and expression on the basis of flexible combination.
