論我國(guó)馳名商標(biāo)異化及其規(guī)制路徑

【摘要】:從我國(guó)馳名商標(biāo)二十多年的保護(hù)歷程中可以看出,在對(duì)馳名商標(biāo)保護(hù)的力度越來(lái)越強(qiáng)的同時(shí),,馳名商標(biāo)制度本身也出現(xiàn)了異化——本應(yīng)作為法律符號(hào)的馳名商標(biāo)異化成了一個(gè)社會(huì)符號(hào),成了一種榮譽(yù)的象征。因此,如何有效扭轉(zhuǎn)與規(guī)制這一異化現(xiàn)象成為我國(guó)政府包括司法部門(mén)須正視的問(wèn)題。為厘清我國(guó)馳名商標(biāo)保護(hù)制度異化現(xiàn)象,本文在結(jié)合社會(huì)現(xiàn)實(shí)的基礎(chǔ)上,首先對(duì)馳名商標(biāo)法律制度的法理基礎(chǔ)作具體探究,而后對(duì)馳名商標(biāo)異化進(jìn)行分類解析;同時(shí)將馳名商標(biāo)保護(hù)制度置于歷史背景之中,解構(gòu)其異化的原因與危害;結(jié)合知識(shí)產(chǎn)權(quán)基本理論及馳名商標(biāo)保護(hù)制度價(jià)值理念等為馳名商標(biāo)保護(hù)尋求利益平衡、提供理念支撐,從而對(duì)各種異化現(xiàn)象提出有步驟、有針對(duì)性、有效的規(guī)制路徑。本文共分為五章對(duì)上述問(wèn)題進(jìn)行具體研究。 第一章主要研究馳名商標(biāo)法律制度的法理基礎(chǔ)。通過(guò)分析馳名商標(biāo)法律制度的產(chǎn)生、馳名商標(biāo)的法律性質(zhì)等基礎(chǔ)理論透視馳名商標(biāo)法律制度。同時(shí),探究國(guó)際公約中與發(fā)達(dá)國(guó)家中的馳名商標(biāo)保護(hù)制度探尋馳名商標(biāo)法律制度的發(fā)展軌跡, 從而為后文提出我國(guó)馳名商標(biāo)異化奠定理論基礎(chǔ)。第二章主要研究我國(guó)馳名商標(biāo)保護(hù)制度的現(xiàn)狀及異化表現(xiàn)。以我國(guó)2013年8月30日修訂的《商標(biāo)法》中關(guān)于馳名商標(biāo)保護(hù)制度的修改為切入點(diǎn),總結(jié)各界對(duì)關(guān)乎其利益的條文所秉持的態(tài)度與看法,提出本文所探討的問(wèn)題——我國(guó)地方政府、各企業(yè)以及消費(fèi)者等對(duì)馳名商標(biāo)存在的認(rèn)識(shí)誤區(qū)。最后指出馳名商標(biāo)保護(hù)制度的異化主要包括馳名商標(biāo)本體異化與馳名商標(biāo)保護(hù)制度在具體運(yùn)行中的異化等兩個(gè)方面。 第三章著眼于分析馳名商標(biāo)異化背后的原因及危害。每一事物向不同方向發(fā)展從而異化,都必然有其歷史因素與現(xiàn)實(shí)因素。本章將通過(guò)還原馳名商標(biāo)保護(hù)制度的歷史背景,指出我國(guó)馳名商標(biāo)保護(hù)制度在移植之初就已出現(xiàn)異化萌芽,之后與各種現(xiàn)實(shí)利益相互交織影響后墮入異化深淵。同時(shí)從我國(guó)商標(biāo)制度及其馳名商標(biāo)保護(hù)制度的建設(shè)與完善的角度出發(fā),檢視這一異化現(xiàn)象所帶來(lái)的沖擊與危害,并為我們指出馳名商標(biāo)制度的癥結(jié)所在。 第四章主要研究規(guī)制馳名商標(biāo)異化的法制理念。從民法體系乃至知識(shí)產(chǎn)權(quán)體系的法制理念出發(fā),詳細(xì)研究利益平衡理論和禁止權(quán)利濫用原則等,以此構(gòu)架馳名商標(biāo)保護(hù)制度的理論基礎(chǔ),從而為消除馳名商標(biāo)異化與完善馳名商標(biāo)保護(hù)制度提供堅(jiān)實(shí)的理念支撐。 第五章主要針對(duì)我國(guó)馳名商標(biāo)保護(hù)制度的異化提出具體、有效的規(guī)制路徑。一方面總結(jié)與評(píng)析我國(guó)對(duì)馳名商標(biāo)異化所做出的努力;另一方面,多層次、多角度、全方位地提出規(guī)制馳名商標(biāo)異化的路徑,即從法律理念的樹(shù)立與傳達(dá)到法律層面的有效完善再到從社會(huì)層面上對(duì)各主體行為的具體規(guī)制,以期實(shí)現(xiàn)我國(guó)馳名商標(biāo)保護(hù)制度的理性回歸。
[Abstract]:In the course of the more than 20 year protection of well-known trademarks in China, it can be seen that, while the protection of well-known trademarks is becoming stronger and stronger, the well-known trademark system itself has also appeared alienation - the well-known trademark, which should be regarded as a legal symbol, became a social symbol and became a symbol of honor. Therefore, how to effectively reverse and regulate it In order to clarify the phenomenon of the alienation of the well-known trademark protection system in our country, on the basis of the social reality, this paper makes a detailed inquiry into the legal basis of the legal system of the well-known trademark, and then classifies the well-known trademark dissimilation; meanwhile, the well-known trademark is made to the well-known trademark. The protection system is placed in the historical background, deconstructs the cause and harm of its alienation; combining the basic theory of intellectual property rights and the value concept of the well-known trademark protection system, it seeks the balance of the interests for the protection of the well-known trademark, and provides the idea support, thus putting forward the steps, pertinence and effective regulation path for various dissimilation phenomena. This article is divided into The five chapter makes a specific research on the above problems.
The first chapter mainly studies the legal basis of the legal system of well-known trademarks. Through the analysis of the emergence of the legal system of well-known trademarks and the legal nature of well-known trademarks, the legal system of well-known trademarks is examined. Meanwhile, the development track of the legal system of well-known trademarks in the international conventions and the well-known trademarks in the developed countries is explored.
The second chapter mainly studies the status and dissimilation of the well-known trademark protection system in our country. This article takes the revision of the Trademark Law of China in August 30, 2013 as the breakthrough point of the revision of the well-known trademark protection system, and summarizes the attitude of all walks of life on its interests. In this paper, we put forward the problems discussed in this paper - the misunderstanding of the existence of well-known trademarks in local governments, enterprises and consumers in our country. Finally, it is pointed out that the alienation of the protection system of well-known trademarks mainly includes two aspects, such as the alienation of well-known trademarks and the alienation of well-known trademark protection system in specific transportation.
The third chapter focuses on the analysis of the causes and hazards behind the alienation of well-known trademarks. Each thing develops in different directions and alienated, all of which must have its historical and realistic factors. This chapter will show the historical background of the protection system of well-known trademarks, and points out that the protection of well-known trademarks in China has emerged at the beginning of the transplantation. At the same time, from the point of view of the construction and perfection of China's trademark system and its well-known trademark protection system, this paper examines the impact and harm of this alienation phenomenon, and points out the crux of the well-known trademark system.
The fourth chapter mainly studies the legal concept of regulating the alienation of well-known trademarks. Starting with the legal concept of the civil law system and even the intellectual property system, the theory of interest balance and the principle of prohibiting the abuse of rights are studied in detail, so as to frame the theoretical basis of the well-known trademark protection system, so as to eliminate the alienation of well-known trademarks and improve the protection of well-known trademarks. The degree provides a solid conceptual support.
The fifth chapter mainly aims at the alienation of the well-known trademark protection system in China, and puts forward specific and effective regulation path. On the one hand, it summarizes and evaluates the efforts made by China for the alienation of well-known trademarks; on the other hand, the path of regulation of the alienation of well-known trademarks is put forward from various levels and angles, that is, from the establishment and transmission of the legal concept to the law. The effective improvement of the level and then the specific regulation of the main body behavior from the social level, in order to realize the rational regression of the well-known trademark protection system in China.
