摘要：

我國(guó)各知識(shí)產(chǎn)權(quán)部門法在知識(shí)產(chǎn)權(quán)損害賠償?shù)木唧w規(guī)則上存在著不一致的情形，導(dǎo)致人們?cè)诶斫�、適用知識(shí)產(chǎn)權(quán)損害賠償規(guī)則時(shí)發(fā)生錯(cuò)誤。從統(tǒng)一我國(guó)知識(shí)產(chǎn)權(quán)制度的角度，有必要對(duì)知識(shí)產(chǎn)權(quán)損害賠償制度進(jìn)行協(xié)調(diào)與統(tǒng)一，，尤其應(yīng)當(dāng)對(duì)知識(shí)產(chǎn)權(quán)損害賠償?shù)挠?jì)算方式及其選擇、法定賠償標(biāo)準(zhǔn)的細(xì)化以及各知識(shí)產(chǎn)權(quán)部門法立法語言的一致性予以考慮、修訂。

Abstract： 

Specific rules of damage compensation of intellectual property （IP） in the domain of Chinese IP Laws are so inconsistent that mistakes may occur when people interpret and apply the damage compensation rules of IP. From the view of unifying IP systems in China, this essay holds it necessary to coordinate and in- tegrate the damage compensation rules of IP, and IP damages, selecting and clarifying the standard guage of IP law particularly to reconsider and amend the way of calculating of statutory reparation, as well as adopting the uniform lan-
