商標(biāo)權(quán)與商號權(quán)的沖突研究

【摘要】:商標(biāo)和商號究其本質(zhì)而言,均屬于作為無形資產(chǎn)的知識產(chǎn)權(quán)的對象,具有區(qū)分功能。但這種區(qū)分功能也存在著些許差異:前者在于區(qū)別、表明商品的特定屬性;后者在于通過商號特征或所擁有的含義,判斷商品來自哪一個經(jīng)營者。兩者作為商業(yè)標(biāo)識也具有內(nèi)在的交叉性,為權(quán)利沖突提供了潛在的可能。沖突現(xiàn)象的日漸猖獗,“旁名牌”、“搭便車”等不正當(dāng)競爭行為不斷出現(xiàn),對經(jīng)濟(jì)秩序的發(fā)展和維護(hù)造成了惡劣的不良影響。與此同時,我國在此領(lǐng)域的行政、立法、司法中存在一些缺陷,對妥善處理兩種權(quán)利的沖突也帶來了一些困難。于是,設(shè)計出何種制度才能杜絕二者之間的沖突,采取什么措施才能在沖突出現(xiàn)的情形下做到公正公平處理,這些問題一直是學(xué)者專家在近十幾年不斷討論的問題。筆者試從商標(biāo)權(quán)與商號權(quán)的聯(lián)系出發(fā),探討他們的沖突的原因,有的放矢,對于怎樣解決這一沖突進(jìn)行預(yù)見性的系統(tǒng)分析,提出若干針對性的意見。論文構(gòu)思如下,除了引言與結(jié)論,共分為四部分:第一部分介紹剖析商標(biāo)與商標(biāo)權(quán)、商號與商號權(quán)的概念、聯(lián)系與區(qū)別。第二部分通過四個典型案例的始末、判決結(jié)果,對商標(biāo)權(quán)與商號權(quán)的沖突形式及相互對抗效力進(jìn)行總結(jié)分析,從而深刻挖掘出沖突產(chǎn)生的緣由。第三部分結(jié)合第二部分所描述的案例,聯(lián)系最新修訂的《商標(biāo)法》,分析在現(xiàn)實生活中處理商標(biāo)權(quán)與商號權(quán)沖突時所運用的基本原則。第四部分對于我國商標(biāo)權(quán)與商號權(quán)沖突解決的相關(guān)思考。從我國現(xiàn)實的基本國情出發(fā),從行政管理模式、法律制度、司法途徑以及企業(yè)自身方面,對解決沖突提出一些針對性的建議。
[Abstract]:Trademark and trade name, in essence, belong to the object of intellectual property as intangible assets and have distinguishing function. However, there are some differences in the differentiation function: the former is the difference, which indicates the specific attributes of the commodity, and the latter is to judge which operator the goods come from through the characteristics of the business name or the meaning it has. They are also intersected as commercial logos, providing potential for conflict of rights. The increasingly rampant conflict phenomenon, "next brand", "free rider" and other unfair competition behavior continue to appear, the development and maintenance of economic order has caused adverse effects. At the same time, there are some defects in the administration, legislation and judicature in this field, which bring some difficulties to the proper handling of the conflict between the two rights. Therefore, what system can be designed to put an end to the conflict between the two, and what measures can be taken to deal with the conflict fairly and fairly? these problems have been discussed by scholars and experts in the past ten years. Starting from the connection between trademark right and trade name right, the author discusses the causes of their conflict, puts forward some suggestions on how to solve the conflict. In addition to the introduction and conclusion, the thesis is divided into four parts: the first part introduces the concepts, connections and differences between trademark and trademark right, trade name and trade name right. The second part summarizes and analyzes the conflict forms of trademark right and trade name right and the effectiveness of mutual confrontation through the beginning and end of four typical cases and the result of judgment, thus deeply excavating the cause of the conflict. The third part combined with the case described in the second part, with the newly revised Trademark Law, analyzes the basic principles used in dealing with the conflict between trademark right and trade name right in real life. The fourth part is about how to resolve the conflict between trademark right and trade name right. Based on the actual situation of our country, this paper puts forward some pertinent suggestions on resolving the conflict from the aspects of administration mode, legal system, judicial approach and enterprise itself.
