【摘要】：知識經(jīng)濟(jì)的到來使得知識產(chǎn)權(quán)發(fā)揮著越來越重要的作用,同時(shí)我國經(jīng)濟(jì)發(fā)展方式的轉(zhuǎn)型對知識產(chǎn)權(quán)的要求更加具體。但現(xiàn)階段我國知識產(chǎn)權(quán)與經(jīng)濟(jì)發(fā)展究竟是怎樣的關(guān)系,我國知識產(chǎn)權(quán)處于怎樣的發(fā)展現(xiàn)狀,它對我國經(jīng)濟(jì)發(fā)展的作用有多大?這些問題需要認(rèn)真思考。要解決這些問題,一方面要挖掘知識產(chǎn)權(quán)的本質(zhì),另一方面則要利用相關(guān)經(jīng)濟(jì)學(xué)知識分析我國知識產(chǎn)權(quán)與經(jīng)濟(jì)發(fā)展的具體關(guān)系。因此本文將以的產(chǎn)權(quán)相關(guān)理論為基礎(chǔ),著重分析以下幾個(gè)問題：(1)我國知識產(chǎn)權(quán)的發(fā)展現(xiàn)狀究竟如何,它與我國的經(jīng)濟(jì)發(fā)展有何聯(lián)系?(2)我國知識產(chǎn)權(quán)對經(jīng)濟(jì)的貢獻(xiàn)度有多大?(3)我國知識產(chǎn)權(quán)未來發(fā)展走向如何,相應(yīng)的發(fā)展思路有哪些? 論文以產(chǎn)權(quán)的相關(guān)理論為基礎(chǔ)說明知識產(chǎn)權(quán)是隨著知識或知識產(chǎn)品成為財(cái)產(chǎn)而產(chǎn)生的,是經(jīng)濟(jì)關(guān)系的一種具體表現(xiàn)形式,經(jīng)濟(jì)發(fā)展決定了知識產(chǎn)權(quán)的發(fā)展程度,知識產(chǎn)權(quán)也影響著經(jīng)濟(jì)發(fā)展的進(jìn)程。在我國現(xiàn)階段的經(jīng)濟(jì)條件下,不僅要關(guān)注知識產(chǎn)權(quán)數(shù)量上的增加,更要注重知識產(chǎn)權(quán)的質(zhì)量以及實(shí)施的效果,唯有如此,才能更好的促進(jìn)經(jīng)濟(jì)發(fā)展；再者,與知識產(chǎn)權(quán)發(fā)展緊密聯(lián)系的制度建設(shè)、人才培養(yǎng)、收益分配和權(quán)利保護(hù)等都是知識產(chǎn)權(quán)發(fā)展必不可少的內(nèi)容,需要從我國經(jīng)濟(jì)發(fā)展的現(xiàn)實(shí)需求出發(fā),形成合理有效的制度框架。以這一觀點(diǎn)為指導(dǎo),論文的基本思路如下： 在理清知識產(chǎn)權(quán)本質(zhì)的前提下,以探討知識產(chǎn)權(quán)和經(jīng)濟(jì)發(fā)展的關(guān)系為主線,從六個(gè)部分進(jìn)行探討分析。第一部分,導(dǎo)論部分,從研究背景、研究意義、相關(guān)概念、以及論文基本思路和研究方法、研究中可能存在的創(chuàng)新點(diǎn)和不足6個(gè)方面對論文進(jìn)行介紹。第二部分,文獻(xiàn)綜述和相關(guān)理論基礎(chǔ)。文獻(xiàn)綜述從知識產(chǎn)權(quán)的產(chǎn)權(quán)理論分析、知識產(chǎn)權(quán)與經(jīng)濟(jì)發(fā)展關(guān)系研究兩個(gè)方面做了總結(jié)；在理論基礎(chǔ)部分以馬克思產(chǎn)權(quán)理論與西方產(chǎn)權(quán)理論的相關(guān)內(nèi)容為基礎(chǔ)揭示知識產(chǎn)權(quán)的本質(zhì)及其與經(jīng)濟(jì)發(fā)展的關(guān)系。第三部分,描述中國知識產(chǎn)權(quán)的發(fā)展現(xiàn)狀及中國知識產(chǎn)權(quán)與經(jīng)濟(jì)發(fā)展的相關(guān)性分析。首先在分析中國知識產(chǎn)權(quán)發(fā)展現(xiàn)狀的基礎(chǔ)上挖掘我國知識產(chǎn)權(quán)發(fā)展歷程中存在的問題；之后根據(jù)我國經(jīng)濟(jì)發(fā)展現(xiàn)狀說明發(fā)展知識產(chǎn)權(quán)的重要性。第四部分是在第三部分的基礎(chǔ)上,建立影響知識產(chǎn)權(quán)發(fā)展的相關(guān)指標(biāo),并對知識產(chǎn)權(quán)和經(jīng)濟(jì)發(fā)展關(guān)系進(jìn)行實(shí)證分析。第五部分探討美國和日本的知識產(chǎn)權(quán)在經(jīng)濟(jì)發(fā)展中不斷完善的過程,進(jìn)一步論證經(jīng)濟(jì)發(fā)展對知識產(chǎn)權(quán)發(fā)展的決定性作用,說明知識產(chǎn)權(quán)在不同階段對經(jīng)濟(jì)發(fā)展所起的作用不同。第六部分為結(jié)論政策建議部分。這一部分主要從我國現(xiàn)在的經(jīng)濟(jì)發(fā)展的實(shí)際情況出發(fā),對知識產(chǎn)權(quán)的發(fā)展提出相應(yīng)的合理建議。 文中主要采用理論和實(shí)證相結(jié)合的分析方法,在理論聯(lián)系實(shí)際,理論指導(dǎo)實(shí)踐,從實(shí)踐中總結(jié)驗(yàn)證理論的原則指導(dǎo)下,廣泛搜集和處理數(shù)據(jù)資料的基礎(chǔ)上,通過理論思維進(jìn)行實(shí)證分析,揭示出問題所在。 在定性分析法中對研究對象進(jìn)行“質(zhì)”的研究,從理論闡述中認(rèn)識知識產(chǎn)權(quán)的本質(zhì),揭示經(jīng)濟(jì)運(yùn)行中知識產(chǎn)權(quán)的影響力。 在定量分析法中,以我國歷史發(fā)展數(shù)據(jù)為基礎(chǔ),對數(shù)據(jù)進(jìn)行有效處理之后運(yùn)用有關(guān)方法,通過eviews5.1軟件進(jìn)行全面的分析和驗(yàn)證,以證明理論分析中得出的結(jié)論。 本文是在已有的對知識產(chǎn)權(quán)研究的基礎(chǔ)上從產(chǎn)權(quán)的角度嘗試解讀知識產(chǎn)權(quán)的本質(zhì)內(nèi)涵、分析知識產(chǎn)權(quán)和經(jīng)濟(jì)發(fā)展的關(guān)系,希望通過相關(guān)的理論分析和實(shí)證研究為今后這一方面的研究提供值得參考的理論支撐。以此為中心,可能有以下創(chuàng)新： 第一、從產(chǎn)權(quán)角度明確知識產(chǎn)權(quán)的本質(zhì)。通過從馬克思產(chǎn)權(quán)理論和西方產(chǎn)權(quán)理論兩個(gè)角度分析知識產(chǎn)權(quán),一方面可以明確認(rèn)識知識產(chǎn)權(quán)的本質(zhì),另一方面可以借助西方產(chǎn)權(quán)理論從微觀角度探索完善知識產(chǎn)權(quán)的思路。 第二、揭示我國知識產(chǎn)權(quán)現(xiàn)階段發(fā)展現(xiàn)狀以及與我國經(jīng)濟(jì)發(fā)展的相關(guān)程度。論文將通過建立較為科學(xué)合理的指標(biāo)體系,闡述知識產(chǎn)權(quán)從形成到產(chǎn)生作用的整個(gè)過程,從多維視角選擇相關(guān)指標(biāo)科學(xué)衡量知識產(chǎn)權(quán)的總體狀況以及整個(gè)過程中所發(fā)揮的作用,全面了解我國知識產(chǎn)權(quán)的發(fā)展現(xiàn)狀和優(yōu)劣程度。 第三、明確現(xiàn)階段我國知識產(chǎn)權(quán)對我國經(jīng)濟(jì)發(fā)展的作用。明確了知識產(chǎn)權(quán)對產(chǎn)業(yè)結(jié)構(gòu)調(diào)整的促進(jìn)作用和經(jīng)濟(jì)發(fā)展方式的轉(zhuǎn)變效果,在此基礎(chǔ)上提出的政策措施更有利于實(shí)現(xiàn)知識產(chǎn)權(quán)與經(jīng)濟(jì)社會的和諧發(fā)展。 第四、為知識產(chǎn)權(quán)的發(fā)展提供有效的理論文獻(xiàn)。論文是在產(chǎn)權(quán)相關(guān)理論的基礎(chǔ)上研究知識產(chǎn)權(quán)與經(jīng)濟(jì)發(fā)展的關(guān)系,一方面探討知識產(chǎn)權(quán)本質(zhì),在此基礎(chǔ)上利用定量研究科學(xué)的衡量知識產(chǎn)權(quán)對經(jīng)濟(jì)發(fā)展的作用,另-方面在發(fā)現(xiàn)規(guī)律的基礎(chǔ)上對現(xiàn)實(shí)問題進(jìn)行分析,為我國知識產(chǎn)權(quán)的深入研究提供了新的途徑和視野。
[Abstract]:The coming of the knowledge economy makes the intellectual property play a more and more important role , and the transformation of our country ' s economic development mode is more specific to the requirement of intellectual property .

On the basis of the theory of property right , the paper indicates that intellectual property rights are generated as knowledge or knowledge products become property . It is a concrete manifestation of economic relations . The economic development determines the development degree of intellectual property rights and the process of economic development . In the present stage of our country , not only the increase of intellectual property rights should be paid attention to , but also the quality of intellectual property rights and the effect of implementation should be paid more attention to , so that economic development can be better promoted ;
Furthermore , the system construction , personnel training , income distribution and protection of rights which are closely related to the development of intellectual property rights are necessary for the development of intellectual property , and the reasonable and effective institutional framework should be formed from the realistic demand of our country ' s economic development .

On the premise of understanding the nature of intellectual property rights , the paper discusses the relationship between intellectual property rights and economic development . The first part , the introduction part , from the research background , the research significance , the relevant concepts , and the paper ' s basic thinking and research methods , the possible innovation points and the less than 6 aspects of the study are introduced in this paper . Part two , the literature review and the relevant theoretical foundation . The literature review summarizes the property right theory analysis , intellectual property and economic development relationship between intellectual property rights .
Based on the theory of Marx ' s property right and the content of western property right theory , the paper reveals the essence of intellectual property rights and its relationship with economic development . Part three describes the development of intellectual property rights in China and the correlation analysis between China ' s intellectual property rights and economic development . Firstly , the problems existing in the course of intellectual property development in China are analyzed on the basis of analyzing the present situation of intellectual property development in China .
The fourth part , on the basis of the third part , establishes the relevant indexes which affect the development of intellectual property rights , and makes an empirical analysis on the relationship between intellectual property rights and economic development . The fifth part discusses the decisive role of intellectual property rights in the development of intellectual property .

This paper mainly adopts the combination of theory and demonstration to analyze and reveal the problem through theoretical thinking under the guidance of theory contact practice , theory guiding practice , and summarizing the principles of verification theory from practice .

In the qualitative analysis method , the research object is " quality " , the essence of intellectual property is recognized from the theoretical exposition , and the influence of intellectual property in economic operation is revealed .

In the quantitative analysis method , based on our country ' s historical development data , the data is effectively processed and the related method is used to carry out comprehensive analysis and verification through the eviews5.1 software to prove the conclusion drawn in the theoretical analysis .

Based on the research of intellectual property rights , this paper attempts to interpret the essence of intellectual property rights from the perspective of property rights , analyzes the relationship between intellectual property rights and economic development , and hopes to provide theoretical support for future research through relevant theoretical analysis and empirical research .

First , the nature of intellectual property is defined from the angle of property right . By analyzing intellectual property from two angles of Marx ' s property right theory and western property right theory , the essence of intellectual property can be clearly recognized on the one hand , and the idea of perfect intellectual property can be explored from the microcosmic angle by means of western property right theory .

Secondly , this paper reveals the present situation of China ' s intellectual property right and its correlation with our country ' s economic development . This paper will set up a more scientific and reasonable index system , expound the whole process of the intellectual property right from the formation to the production function , choose the relevant index science from the multi - dimensional visual angle to measure the overall situation of the intellectual property and the role played by the whole process , fully understand the development status and the degree of the intellectual property of our country .

Thirdly , it is clear that China ' s intellectual property plays an important role in China ' s economic development . The promotion of intellectual property rights to industrial structure adjustment and the transformation effect of economic development mode are clarified , and the policy measures are more conducive to the harmonious development of intellectual property rights and economic society .

Fourthly , to provide effective theoretical papers for the development of intellectual property rights . This paper studies the relationship between intellectual property rights and economic development on the basis of property rights - related theories . On the one hand , the paper discusses the nature of intellectual property rights . On the other hand , we use quantitative research to measure the effect of intellectual property on economic development .
