【摘要】：職務發(fā)明制度是社會發(fā)展和科技進步的產(chǎn)物。職務發(fā)明的權利歸屬與利益分配，關系到發(fā)明人、發(fā)明人所在企業(yè)與整個社會等多方利益。合理的職務發(fā)明權屬制度，有利于平衡各方面的利益，不僅影響著發(fā)明人及發(fā)明人所在企業(yè)從事發(fā)明創(chuàng)造的積極性，也影響著企業(yè)創(chuàng)新的持續(xù)發(fā)展與整個社會的科技進步和生產(chǎn)效率，對我國自主知識產(chǎn)權的形成和實施應用起到重要的積極作用。 本文以我國現(xiàn)行的職務發(fā)明權屬制度為主要研究內(nèi)容。全文除導言和結論外主要分為三個部分。文章第一章介紹了職務發(fā)明的權屬制度現(xiàn)狀，主要分為國內(nèi)外研究綜述、我國職務發(fā)明權屬制度的規(guī)定和我國職務發(fā)明制度運行現(xiàn)狀。文章第二章對我國職務發(fā)明權屬制度存在的問題進行了分析探討，包括職務發(fā)明的權利歸屬、職務發(fā)明的利益分配、企業(yè)對于發(fā)明人的獎勵和報酬等激勵措施、對職務發(fā)明相關制度的評估與考核、以及監(jiān)管體系存在的漏洞等方面。文章第三章針對存在的問題對我國職務發(fā)明權屬制度提出了相關建議，，希望能夠更好地促進我國現(xiàn)行職務發(fā)明制度的建立和完善，更好地激發(fā)企業(yè)與發(fā)明人進行發(fā)明創(chuàng)造的熱情，促進企業(yè)的技術創(chuàng)新，從而提升我國的科技水平。
[Abstract]:The system of job invention is the product of social development and scientific and technological progress. The ownership and benefit distribution of duty invention is related to the inventors, inventors' enterprises and the whole society. A reasonable system of ownership of job inventions is conducive to balancing the interests of all sides, and not only affects the initiative of inventors and inventors in their enterprises engaged in invention-creation, It also affects the sustainable development of enterprise innovation and the scientific and technological progress and production efficiency of the whole society, and plays an important and positive role in the formation and implementation of independent intellectual property rights in China. This article takes the present duty invention ownership system as the main research content. In addition to the introduction and conclusions, the full text is divided into three parts. The first chapter introduces the present situation of the tenure system of the job invention, which is mainly divided into the domestic and foreign research summary, the regulation of the tenure system of the duty invention in our country and the present situation of the operation of the duty invention system in our country. The second chapter analyzes and discusses the problems existing in the ownership system of job inventions in China, including the ownership of the right to the invention, the distribution of the benefits of the invention, the incentive measures of the enterprise to the inventor, and so on. The evaluation and assessment of the relevant system of job invention, as well as the loopholes existing in the regulatory system and so on. In the third chapter, the author puts forward some suggestions on the ownership system of job inventions in China, hoping to promote the establishment and improvement of the present system of job inventions in China. It can better stimulate the enthusiasm of enterprises and inventors to invent and create, promote the technological innovation of enterprises, and thus raise the level of science and technology in our country.
