【摘要】：印刷線路板（Printed Circuit Board），行業(yè)術(shù)語中稱為PCB，又稱印制電路板或者印刷線路板，是以絕緣材料為基板，按照預(yù)定的布局，設(shè)計(jì)出印刷線路，布置好元器件的位置，然后依照設(shè)計(jì)的圖形生產(chǎn)出電路板。在現(xiàn)代電子工業(yè)中，我們接觸到的電子產(chǎn)品基本都包含了它，電筒、開關(guān)，甚至航天航空和軍用設(shè)備等，只要涉及到電子元件的安插與連接，幾乎都需要PCB，是電子元器件的支撐體，也是電子元器件連接的提供者。 各類電子產(chǎn)品和LED等的發(fā)展將強(qiáng)勁推動(dòng)印制電路板行業(yè)的發(fā)展，預(yù)計(jì)在未來五年中國印制電路板行業(yè)仍將繼續(xù)保持快速增長態(tài)勢。由此可知，印制電路板行業(yè)對于我國經(jīng)濟(jì)發(fā)展具有重要的作用。我國印制電路板行業(yè)的有序發(fā)展對我國經(jīng)濟(jì)發(fā)展具有重要作用，但這有賴于對印制電路板的有效保護(hù)。但現(xiàn)實(shí)卻是，隨著技術(shù)的發(fā)展，印制電路板的盜版現(xiàn)象越來越嚴(yán)重。鑒于印制電路板布圖設(shè)計(jì)者投入了智力勞動(dòng)，存在給予保護(hù)的法理正當(dāng)性和經(jīng)濟(jì)正當(dāng)性，并且印制電路板布圖設(shè)計(jì)的獨(dú)特屬性符合知識產(chǎn)權(quán)的特征，因此，我們有必要對印制電路板布圖設(shè)計(jì)進(jìn)行知識產(chǎn)權(quán)保護(hù)。 截至目前，已經(jīng)發(fā)生了多起涉及印制電路板布圖設(shè)計(jì)的保護(hù)的案件，但由于國內(nèi)外沒有專門保護(hù)印制電路板布圖設(shè)計(jì)的法律，保護(hù)的主要方式基本是借鑒著作權(quán)法等相關(guān)知識產(chǎn)權(quán)法律規(guī)定，由于印制電路板布圖設(shè)計(jì)的自身特性無法滿足著作權(quán)法關(guān)于作品的界定，，不適用著作權(quán)法規(guī)定的復(fù)制行為以及保護(hù)期限過長等，也無法滿足專利法關(guān)于發(fā)明和實(shí)用新型的定義和外觀設(shè)計(jì)的保護(hù)范圍，還無法滿足集成電路布圖設(shè)計(jì)要求的“執(zhí)行某種電子功能”以及不能滿足反不正當(dāng)競爭法中的秘密性，因此，現(xiàn)行法律無法有效保證印制電路板布圖設(shè)計(jì)。 鑒于現(xiàn)行法律無法有效保護(hù)印制電路板布圖設(shè)計(jì)，筆者依據(jù)印制電路板布圖設(shè)計(jì)的特點(diǎn)，結(jié)合現(xiàn)行相關(guān)法律法規(guī)，從權(quán)利主體，權(quán)利客體，權(quán)利內(nèi)容，權(quán)利取得方式和侵權(quán)判斷及救濟(jì)方式等方面提出建議，以期望建立一套有效的印制電路板布圖設(shè)計(jì)的知識產(chǎn)權(quán)保護(hù)機(jī)制，為未來有效保護(hù)印制電路板布圖設(shè)計(jì)奠定基礎(chǔ)，促進(jìn)我國市場經(jīng)濟(jì)的良性發(fā)展及技術(shù)的改進(jìn)。 筆者相信，隨著關(guān)于印制電路板布圖設(shè)計(jì)研究的深入與全面，我們將探討出全面而合理的保護(hù)體系。
[Abstract]:Printed Circuit Board (PCB), also called PCB, or printed Circuit Board (PCB), is a printed circuit line designed according to the predetermined layout and the position of the components, which is based on the insulating material. Then the circuit board is produced according to the design graphics. In the modern electronics industry, most of the electronic products we come into contact with include them, flashlights, switches, even aerospace and military equipment, as long as they involve the placement and connection of electronic components. Almost all need PCB, which is the support of electronic components and the provider of electronic components connection. The development of various electronic products and LEDs will strongly promote the development of the printed circuit board industry. China's printed circuit board industry is expected to continue to grow rapidly in the next five years. It can be seen that the printed circuit board industry has an important role in the economic development of our country. The orderly development of the printed circuit board industry in China plays an important role in the economic development of our country, but it depends on the effective protection of the printed circuit board. But the reality is, with the development of technology, printed circuit board piracy is becoming more and more serious. In view of the intellectual labor of printed circuit board layout designers, there are legal legitimacy and economic legitimacy of protection, and the unique attributes of printed circuit board layout design accord with the characteristics of intellectual property, therefore, It is necessary for us to protect the intellectual property rights of the layout design of the printed circuit board. So far, there have been many cases involving the protection of the layout design of the printed circuit board. However, since there are no laws at home and abroad that specifically protect the layout design of printed circuit boards, the main way to protect them is basically to draw lessons from relevant intellectual property laws such as the copyright Law. Because the characteristics of the layout design of printed circuit board can not meet the definition of the works in the copyright law, it is not applicable to the reproduction behavior stipulated by the copyright law, and the protection period is too long, and so on. Unable to meet the definition of invention and utility models in patent law and the scope of protection of designs, the "performance of certain electronic functions" required by layout-design requirements for integrated circuits and the secrecy in anti-unfair competition law, Therefore, the current laws can not effectively guarantee the layout design of printed circuit boards. In view of the fact that the current laws cannot effectively protect the layout design of printed circuit boards, the author, according to the characteristics of the layout design of printed circuit boards, combines the existing relevant laws and regulations, In order to establish an effective intellectual property protection mechanism for PCB layout design, suggestions are put forward from the aspects of subject of rights, object of rights, content of rights, ways of obtaining rights, judgment of infringement and ways of remedy, etc. It will lay a foundation for the effective protection of PCB layout design in the future, and promote the benign development of market economy and the improvement of technology in our country. The author believes that with the thorough and comprehensive research on PCB layout design, We will explore a comprehensive and reasonable protection system.
