【摘要】:《視聽表演北京條約》于2012年6與26日在北京簽訂,,首次將視聽表演及其表演者納入到知識產權國際層面的保護體系之中,填補了視聽表演國際權利制度的空白,為保護表演者提供了更為全面、清晰的保護。立足條約本身,運用歷史研究、對比研究、實證研究等多種研究方法,進一步分析該條約,厘清該條約與其他條約的關系和及其地位,闡釋其重要影響,探討該條約對于我國國內法的影響。 由于科技和經濟發(fā)展等綜合原因,表演被人為地分割成了聲音表演和視聽表演。國際社會對于聲音表演的保護很早便得以實現(xiàn),但對于視聽表演的保護則發(fā)展緩慢!兑暵牨硌荼本l約》所規(guī)制的主體是視聽表演,條約包括目錄、序言以及30條條款,其中的條款包括實質條款、行政條款和最后條款。該條約在范疇上應該屬于世界性知識產權保護條約,置于著作權與相關權利項下的相關權利之中,與聲音表演保護條約屬于并列關系。 《視聽表演北京條約》在北京簽訂,是對我國知識產權保護工作的鼓勵,提升了中國在此方面的話語權。該條約對于我國著作權法的修訂有著重要影響,特別是在專業(yè)名詞的使用、視聽表演方面權利的設置與救濟等,提供了新的視野和思路。
[Abstract]:The Beijing Treaty on Audio-visual performance, signed in Beijing on June and 26, 2012, for the first time incorporated audiovisual performances and performers into the system of protection of intellectual property rights at the international level, filling the gap in the system of international rights for audiovisual performances, For the protection of performers to provide a more comprehensive, clear protection. Based on the treaty itself, using various research methods, such as historical research, comparative study, empirical research, etc., to further analyze the treaty, clarify the relationship and status between the treaty and other treaties, and explain its important influence. This paper probes into the influence of the treaty on the domestic law of our country. Due to the comprehensive reasons of science and technology and economic development, the performance is artificially divided into sound performance and audiovisual performance. The protection of sound performance by the international community was realized very early, but the protection of audiovisual performance developed slowly. The subject of the Beijing Treaty on Audio-visual performance is audio-visual performance, which includes a catalogue, a preamble and 30 articles. The provisions include substantive, administrative and final clauses. In terms of scope, the treaty should belong to the universal intellectual property protection treaty, be placed among the relevant rights under copyright and related rights, and be in parallel with the sound performance protection treaty. The Beijing Treaty on Audio-visual performance was signed in Beijing. Is to our country intellectual property protection work encouragement, enhanced China in this aspect the right of speech. This treaty has an important influence on the revision of copyright law in China, especially in the use of professional terms, the establishment and relief of rights in audiovisual performances, etc., which provides a new vision and train of thought.
