【摘要】：2012年2月，知識(shí)產(chǎn)權(quán)與遺傳資源、傳統(tǒng)知識(shí)和民間文學(xué)藝術(shù)政府委員會(huì)在日內(nèi)瓦召開(kāi)第二十屆會(huì)議，又一次提及遺傳資源利益分享的國(guó)際和國(guó)內(nèi)立法�？梢�(jiàn)，在今日的世界，人們逐漸意識(shí)到生物遺傳資源的重要性及生物遺傳資源減少的嚴(yán)重危害性。當(dāng)今，現(xiàn)代生物技術(shù)快速發(fā)展，帶來(lái)了重大的經(jīng)濟(jì)利益。作為生物技術(shù)的原材料，生物遺傳資源的價(jià)值正慢慢凸顯，，加劇了遺傳資源匱乏的發(fā)達(dá)國(guó)家對(duì)遺傳資源豐富的發(fā)展中國(guó)家的生物剽竊行為。因此，在國(guó)際立法的框架下，制定國(guó)內(nèi)遺傳資源利益分享保護(hù)的法律，抑制發(fā)達(dá)國(guó)家對(duì)發(fā)展中國(guó)家的“生物剽竊”行為，平衡雙方利益，達(dá)到保護(hù)生物多樣性可持續(xù)利用目的，至關(guān)重要。 本文由四個(gè)部分組成。第一部分闡述遺傳資源利益分享法律保護(hù)的必要性。第二部分分析現(xiàn)階段我國(guó)遺傳資源利益分享立法保護(hù)現(xiàn)狀及其存在的不足。第三部分闡述《生物多樣性公約》和《生物多樣性公約關(guān)于獲取遺傳資源和公平和公正分享其利用所產(chǎn)生惠益的名古屋議定書(shū)》關(guān)于遺傳資源利益分享的保護(hù)規(guī)則。鑒于我國(guó)遺傳資源利益分享保護(hù)立法嚴(yán)重滯后于國(guó)際立法并存在嚴(yán)重不足，第四部分對(duì)我國(guó)遺傳資源利益分享法律保護(hù)的構(gòu)造提出了建議。該部分對(duì)立法模式的選擇及遺傳資源利益分享保護(hù)制度的主要架構(gòu)進(jìn)行了探討、分析。
[Abstract]:In February 2012, the Government Committee on intellectual property and genetic Resources, traditional knowledge and folklore held its twentieth session in Geneva, again referring to international and national legislation on benefit-sharing of genetic resources. Therefore, in today's world, people gradually realize the importance of biological genetic resources and the serious harm of the reduction of biological genetic resources. Nowadays, the rapid development of modern biotechnology has brought great economic benefits. As the raw material of biotechnology, the value of biogenetic resources is becoming more and more important, which intensifies the biologic plagiarism behavior of the developed countries which are short of genetic resources to the developing countries with abundant genetic resources. Therefore, within the framework of international legislation, laws should be enacted to protect the benefit sharing of domestic genetic resources in order to curb the "bio-plagiarism" of developed countries against developing countries, to balance the interests of both sides and to achieve the goal of protecting the sustainable use of biodiversity, It is vital. This paper consists of four parts. The first part expounds the necessity of the legal protection of the benefit sharing of genetic resources. The second part analyzes the current situation and shortcomings of the legislation protection of the benefit sharing of genetic resources in China. The third part deals with the protection rules of the Convention on Biological Diversity and the Nagoya Protocol to the Convention on Biological Diversity on access to genetic resources and the fair and equitable sharing of benefits arising from their utilization. In view of the fact that the legislation of benefit sharing protection of genetic resources in China lags behind the international legislation seriously, the fourth part puts forward some suggestions on the construction of the legal protection of the benefit sharing of genetic resources in China. This part discusses the choice of legislative model and the main framework of the benefit sharing protection system of genetic resources.
