【摘要】:傳統(tǒng)手工技藝是人們長期總結(jié)創(chuàng)造出來的智慧性勞動成果,具有極高的科學研究價值、文化價值和經(jīng)濟價值。近年來,隨著經(jīng)濟的快速發(fā)展和過度的商業(yè)開發(fā),許多傳統(tǒng)技藝瀕臨滅絕,其生存狀況經(jīng)受著巨大的挑戰(zhàn)。因此,傳統(tǒng)手工技藝的保護問題已經(jīng)是相關(guān)組織,政府部門和學術(shù)界研究的共同焦點。本文以知識產(chǎn)權(quán)制度為手段,闡述對傳統(tǒng)手工技藝的保護,主要分為四個部分。 第一部分從傳統(tǒng)手工技藝的基礎理論展開分析。首先介紹我國傳統(tǒng)手工技藝的發(fā)展歷程并在漫長的歷史進程中,形成了實用性和審美性相統(tǒng)一、民族性和時代性相統(tǒng)一、深厚的文化內(nèi)涵和濃重的地方色彩相統(tǒng)一的特點,進而提出傳統(tǒng)手工技藝科學、文化、經(jīng)濟等價值,反映了保護傳統(tǒng)手工技藝的必要性。 第二部分的主要內(nèi)容是闡述國內(nèi)外傳統(tǒng)手工技藝保護模式的選擇,對以日本、美國、巴拿馬為代表的三種保護模式分別做出介紹,從而引出目前我國對傳統(tǒng)手工技藝法律保護的規(guī)定,,比較《非物質(zhì)文化遺產(chǎn)法》、《傳統(tǒng)工藝美術(shù)保護條例》、《知識產(chǎn)權(quán)法》對我國傳統(tǒng)手工技藝保護,得出了利用知識產(chǎn)權(quán)保護傳統(tǒng)手工技藝的優(yōu)勢。 第三部分是介紹用現(xiàn)有知識產(chǎn)權(quán)制度保護傳統(tǒng)手工技藝所存在的不足與可行性分析,從而提出后面保護措施的完善。 第四部分是傳承人的法律保護,傳承人是技藝的靈魂所在,加強傳承人的法律保護是整個保護工作的基礎,也是重中之重。本節(jié)從《非遺法》對傳承人規(guī)定內(nèi)容的問題分析,完善傳承人法律保護。第五部分是用四個實際案例對應知識產(chǎn)權(quán)體系中的專利、著作、商標、商業(yè)秘密,通過對實際案例的分析,提出知識產(chǎn)權(quán)保護傳統(tǒng)手工技藝的具體措施,從而進一步完善我國傳統(tǒng)手工技藝的知識產(chǎn)權(quán)保護。
[Abstract]:Traditional craftsmanship is the result of intellectual labor that people have summarized and created for a long time, which has high scientific research value, cultural value and economic value. In recent years, with the rapid development of economy and excessive commercial development, many traditional techniques are on the verge of extinction. Therefore, the protection of traditional handicraft technology has been the common focus of relevant organizations, government departments and academia. This paper, by means of intellectual property system, expounds the protection of traditional handicraft, which is divided into four parts. The first part analyzes the basic theory of traditional handicraft. First of all, it introduces the development course of Chinese traditional handicraft technology and in the long historical process, it has formed the characteristics of practicability and aesthetics, nationality and times, profound cultural connotation and strong local color. The value of traditional handicraft science, culture, economy and so on is put forward, which reflects the necessity of protecting traditional handicraft technique. The second part of the main content is to elaborate the domestic and foreign traditional handcraft protection mode choice, to take Japan, the United States, Panama as the representative three kinds of protection models respectively to make the introduction. Therefore, we can draw out the legal protection of traditional handicraft in our country at present, comparing with the Intangible Cultural Heritage Law, the regulations on the Protection of traditional Arts and Crafts, and the Protection of traditional Handicraft in China by intellectual property Law. The advantage of using intellectual property to protect traditional handicraft is obtained. The third part is to introduce the shortcomings and feasibility of using the existing intellectual property system to protect the traditional handicraft, and then put forward the perfection of the later protection measures. The fourth part is the legal protection of the inheritor, the inheritor is the soul of the art, strengthening the legal protection of the inheritor is the basis of the whole protection work, but also the most important. This section from the "non-inheritance Law" to the inheritance of the content of the analysis, improve the legal protection of inheritors. The fifth part uses four actual cases to correspond to the patents, works, trademarks and trade secrets in the intellectual property system. Through the analysis of the actual cases, the author puts forward the specific measures to protect the traditional handicraft skills with the intellectual property rights. In order to further improve our traditional handicraft intellectual property protection.
