【摘要】：美國聯(lián)邦政府高等教育公共治理中的科技創(chuàng)新策略是美國走向并保持強國地位的有力舉措,其中對大學知識產(chǎn)權(quán)事務的巧妙介入堪稱典型。通過文獻研究法和判例研究法發(fā)現(xiàn)美國聯(lián)邦政府利用憲法"知識產(chǎn)權(quán)保護權(quán)"條款的明示性專有權(quán)力,可以通過引導大學知識產(chǎn)權(quán)走向、決定大學知識產(chǎn)權(quán)權(quán)限、介入大學知識產(chǎn)權(quán)管理、保護大學知識產(chǎn)權(quán)成果、規(guī)制大學知識產(chǎn)權(quán)行為、形成大學知識產(chǎn)權(quán)判例等方式來驅(qū)動大學創(chuàng)新創(chuàng)業(yè),從而形成一種依"知識產(chǎn)權(quán)保護權(quán)"條款的高等教育公共治理權(quán)。研究結(jié)果表明,美國聯(lián)邦政府充分而適當?shù)匦惺怪@種高等教育公共治理權(quán),通過謹慎而善意地介入大學知識產(chǎn)權(quán)事務,起到了以"知識產(chǎn)權(quán)保護權(quán)"之火點燃大學創(chuàng)新創(chuàng)業(yè)之油之功效并有效達成了實現(xiàn)國家科技創(chuàng)新的戰(zhàn)略目的。
[Abstract]:The strategy of scientific and technological innovation in the public governance of higher education in the United States is a powerful measure for the United States to move towards and maintain its position as a powerful country, among which the ingenious intervention in the intellectual property affairs of universities can be regarded as a typical one. Through literature research and case law, it is found that the federal government of the United States can use the express exclusive power of the "intellectual property protection right" clause in the Constitution to determine the intellectual property rights of universities by guiding the trend of intellectual property rights of universities. Intervention in university intellectual property management, protection of university intellectual property achievements, regulation of university intellectual property behavior, formation of university intellectual property jurisprudence, etc., to drive university innovation and entrepreneurship. Thus forms a kind of higher education public administration right according to "intellectual property right protection right" clause. The results show that the federal government of the United States fully and appropriately exercises this right of public governance of higher education by intervening in the intellectual property affairs of universities in a prudent and well-intentioned manner. It has the effect of igniting the oil of university innovation with the fire of "intellectual property right" and achieving the strategic goal of national scientific and technological innovation.
