【摘要】：21世紀是知識經濟時代，，人們在創(chuàng)造更多知識的同時，也更加關注知識產權保護問題。隨著知識經濟的深入，隱性知識的重要性與價值凸顯，其產權保護問題變得迫切�，F(xiàn)行知識產權制度保護的大都是傳統(tǒng)知識，隱性知識產權保護問題還未專門涉及。 在廣泛收集隱性知識相關資料基礎上，綜合運用學科交叉法和歸納總結等方法，創(chuàng)新性的研究了隱性知識產權問題。首先，從整體上概括了隱性知識和知識產權的內涵；然后，在隱性知識產權不受保護的原因基礎上分析了隱性知識產權保護的可能性與必要性；最后，探討了隱性知識和商業(yè)秘密在產權保護上的交叉性，借鑒了傳統(tǒng)知識（或非物質文化遺產）產權保護的具體措施，并就如何保護隱性知識產權問題提出了若干設想。文章創(chuàng)新之處在于，第一，從知識產權角度研究隱性知識，讓人們從意識上認同隱性知識產權的保護；第二，目前學術界對于隱性知識產權問題少有涉及，特別是隱性知識產權保護的措施，筆者借鑒了傳統(tǒng)知識與商業(yè)秘密產權保護相關內容，提出了具體建議措施；第三，通過對隱性知識產權問題研究，打破現(xiàn)有知識產權保護的局限性，擴大知識產權對象的范圍。鑒于缺乏實踐研究，加之能力有限，使得文章在保護措施等方面缺乏說服力，對隱性知識產權問題的闡釋不夠清楚明白。 總之，通過對隱性知識產權保護的可能性、必要性和措施等方面的分析，發(fā)現(xiàn)隱性知識產權問題研究具有很大現(xiàn)實意義。隱性知識需要法律規(guī)范確保其知識產權的地位，制定有效的實踐措施保護其知識產權屬性，保護隱性知識持有人的合法權益，充分發(fā)揮其社會價值與經濟價值。
[Abstract]:The 21st century is the era of knowledge economy. People pay more attention to the protection of intellectual property while creating more knowledge. With the deepening of knowledge economy, the importance and value of tacit knowledge become more and more important. The current intellectual property system protection is mostly traditional knowledge, tacit intellectual property protection has not been specifically involved. On the basis of collecting relevant data of tacit knowledge, this paper studies the tacit intellectual property problem innovatively by using the methods of subject intersection and induction and summarization. Firstly, it generalizes the connotation of tacit knowledge and intellectual property as a whole; then, it analyzes the possibility and necessity of tacit intellectual property protection on the basis of the reason why tacit intellectual property is not protected. This paper probes into the intersectionality of tacit knowledge and trade secret in the protection of property rights, draws lessons from the concrete measures of the protection of traditional knowledge (or intangible cultural heritage) property rights, and puts forward some tentative ideas on how to protect the implicit intellectual property rights. The innovation of this paper lies in: first, to study tacit knowledge from the angle of intellectual property, so that people can identify with the protection of recessive intellectual property from the perspective of consciousness; second, at present, there is little concern in academic circles about the problem of tacit intellectual property. In particular, the measures of the protection of tacit intellectual property rights, the author draws lessons from the traditional knowledge and the protection of trade secrets property rights, put forward specific measures; third, through the study of hidden intellectual property rights, To break the limitations of existing intellectual property rights protection and expand the scope of intellectual property rights objects. In view of the lack of practical research and limited ability, the article lacks persuasion in protection measures, and the explanation of hidden intellectual property rights is not clear enough. In a word, through the analysis of the possibility, necessity and measures of the protection of hidden intellectual property, it is found that the study of hidden intellectual property is of great practical significance. Tacit knowledge needs legal norms to ensure its status of intellectual property, formulate effective practical measures to protect its intellectual property attribute, protect the legitimate rights and interests of holders of tacit knowledge, and give full play to its social and economic value.
