【摘要】：隨著國內(nèi)外中藥知識產(chǎn)權(quán)糾紛數(shù)量的日益增加，中藥知識產(chǎn)權(quán)的法律保護問題已經(jīng)迫在眉睫。筆者認為，中藥知識的本質(zhì)屬性為智力成果，雖然與一般的智力成果有所區(qū)別，，但隨著科技的發(fā)展和知識產(chǎn)權(quán)制度的變革，中藥知識終究應(yīng)當適用現(xiàn)行知識產(chǎn)權(quán)制度來對其加以保護，而非單獨為其創(chuàng)設(shè)一種新型權(quán)利。中藥知識產(chǎn)權(quán)的法律保護問題，調(diào)整現(xiàn)行知識產(chǎn)權(quán)立法是基礎(chǔ)，其中又以《專利法》、《商標法》和商業(yè)秘密的相關(guān)立法的修改調(diào)整為重；在司法保護方面，應(yīng)當注重建立統(tǒng)一的中藥知識產(chǎn)權(quán)侵權(quán)認定標準、設(shè)計適當?shù)脑V訟程序以及盡量健全對中藥知識的保護范圍；在行政保護方面，一方面應(yīng)當關(guān)注對原先代替《專利法》發(fā)揮作用的中藥品種保護制度的修改調(diào)整，另一方面，應(yīng)當進一步完善中藥知識產(chǎn)權(quán)法律保護的行政救濟措施。 本文首先在第一章對中藥知識的基本理論進行了闡述，說明中藥知識的法律定位并分析了適用現(xiàn)行知識產(chǎn)權(quán)制度對其進行保護的可行性，為下文論述應(yīng)當如何調(diào)整現(xiàn)行知識產(chǎn)權(quán)制度奠定了前提基礎(chǔ)。第二章中對國際組織以及各發(fā)展中國家在相關(guān)問題上的經(jīng)驗和做法進行了分析對比，并從中獲得能夠為我國所借用的經(jīng)驗。第三章分析了我國目前在立法、司法和行政三方面對中藥知識產(chǎn)權(quán)進行保護的現(xiàn)狀和存在問題，在第四章中，同樣從立法、司法和行政三方面為完善我國中藥知識產(chǎn)權(quán)的法律保護制度提出了詳細的建議。
[Abstract]:With the increasing number of intellectual property disputes of traditional Chinese medicine at home and abroad, the legal protection of intellectual property rights of traditional Chinese medicine is imminent. The author believes that the essential attribute of traditional Chinese medicine knowledge is intellectual achievement, although it is different from general intellectual achievement, but with the development of science and technology and the reform of intellectual property system, The knowledge of traditional Chinese medicine should be protected by the current intellectual property system, rather than creating a new right. The legal protection of intellectual property rights of traditional Chinese medicine is based on the adjustment of current intellectual property legislation, in which the revision and adjustment of the relevant legislation of the Patent Law, the Trademark Law and the trade secrets are the most important; in terms of judicial protection, Attention should be paid to the establishment of a unified standard for the determination of intellectual property rights infringement of traditional Chinese medicine, the design of appropriate litigation procedures and the improvement of the scope of protection of knowledge of traditional Chinese medicine as far as possible; in the area of administrative protection, On the one hand, we should pay attention to the modification and adjustment of the protection system of traditional Chinese medicine varieties that used to play a role in the Patent Law, on the other hand, we should further improve the administrative relief measures for the legal protection of intellectual property rights of traditional Chinese medicine. In the first chapter, the author expounds the basic theory of TCM knowledge, explains the legal orientation of TCM knowledge and analyzes the feasibility of applying the current intellectual property system to protect it. It lays a foundation for how to adjust the current intellectual property system. The second chapter analyzes and compares the experiences and practices of international organizations and various developing countries on related issues, and obtains the experience that can be borrowed for our country. The third chapter analyzes the current situation and existing problems of Chinese traditional medicine intellectual property protection in the legislative, judicial and administrative aspects. In the fourth chapter, the same from the legislation, The judicial and administrative aspects provide detailed suggestions for perfecting the legal protection system of intellectual property rights of traditional Chinese medicine in China.
