【摘要】：民以食為天,食以種為先。未來,有兩個技術(shù)會制約我們,一是網(wǎng)絡(luò)技術(shù),一是生物技術(shù)。2010年,中央“一號文件”中明確提到要“抓緊培育有核心競爭力的大型種子企業(yè)”,引起了業(yè)內(nèi)的強烈關(guān)注。在農(nóng)業(yè)企業(yè)領(lǐng)域,知識產(chǎn)權(quán)競爭激烈。誰掌握了農(nóng)業(yè)知識產(chǎn)權(quán),誰就掌握了主動權(quán),誰掌握的農(nóng)業(yè)知識產(chǎn)權(quán)多,誰的主動性就大。怎樣才能提升我國現(xiàn)代種業(yè)的競爭能力?包括我國著名農(nóng)業(yè)生物技術(shù)專家范云六院士、著名蔬菜育種專家方智遠院士、著名玉米育種專家戴景瑞院士在內(nèi)的多位業(yè)內(nèi)權(quán)威人士都不約而同地強調(diào),要大力發(fā)展生物技術(shù),增強種業(yè)科技創(chuàng)新能力。 植物新品種保護又稱植物育種者權(quán)利保護,是對植物新品種的知識產(chǎn)權(quán)保護形式,它與專利權(quán)、著作權(quán)、商標專用權(quán)一樣,同屬于知識產(chǎn)權(quán)范疇。近年來,隨著科技體制改革的深化,農(nóng)業(yè)科技也得到了較大的發(fā)展,但由于我國農(nóng)業(yè)科技市場體系建設(shè)滯緩尚處于起步發(fā)展階段,理論界對有關(guān)植物新品種權(quán)界定、植物新品種權(quán)交易運作方式、植物新品種權(quán)估價、植物新品種權(quán)實施應(yīng)用等問題尚未形成統(tǒng)一認識;實踐中植物新品種權(quán)界定模糊、產(chǎn)權(quán)流失、產(chǎn)權(quán)交易流轉(zhuǎn)不暢、產(chǎn)權(quán)實施率低、技術(shù)侵權(quán)等現(xiàn)象時有發(fā)生,植物新品種權(quán)交易運作及其保護與管理等方面都存在著許多不完善、不規(guī)范的地方,潛伏著許多制約植物新品種權(quán)有效運作的矛盾與問題,本文從基本理論入手,通過對植物新品種權(quán)基本概念的界定,運用法經(jīng)濟學方法進行分析,觀察借鑒國外對植物新品種權(quán)的保護,分析我國植物新品種權(quán)保護的狀況,從而對我國植物新品種的保護提出制度上的完善。 本文主要分為四個部分。 第一部分主要討論了植物新品種權(quán)的客體及權(quán)利屬性,以及獨立的知識產(chǎn)權(quán)制度保護的正當性。對植物新品種進行了界定,通過與其他知識產(chǎn)品的比較認識植物新品種的特征,闡述植物新品種權(quán)的概念與特征。同時運用法經(jīng)濟學的分析方法,以法經(jīng)濟學的產(chǎn)權(quán)經(jīng)濟學理論、交易成本理論、博弈論為理論分析工具,分析為什么對植物新品種進行知識產(chǎn)權(quán)保護,探索在制度的設(shè)計上應(yīng)遵循的方法。 第二部分主要通過介紹美國、歐洲、日本等國家對植物新品種保護的制度方法,加以分析評論,從而探索國際植物新品種保護的發(fā)展趨勢以及我國在國際大背景下所面臨的挑戰(zhàn)。 第三部分主要介紹我國植物新品種保護的現(xiàn)狀以及保護機構(gòu);介紹了我國植物新品種保護體系目前存在的問題,并分析了其產(chǎn)生的原因。 第四部分主要根據(jù)我國目前植物新品種保護存在的問題及原因提出了完善的建議。首先提出我國植物新品種保護制度創(chuàng)新要堅持公共利益原則和利益平衡原則;其次,提出完善植物新品種權(quán)保護的法律體系,相關(guān)的配套程序,對植物新品種權(quán)進行合理的限制,加強國際合作四個方面具體建議。探索建立與我國發(fā)展階段相適應(yīng)的新品種保護體系,使之成為激勵創(chuàng)新、優(yōu)化資源配置、調(diào)節(jié)利益格局、維護市場競爭秩序的重要機制。
[Abstract]:In the future , there are two technologies to restrict us , one is network technology , and one is biotechnology . In 2010 , the central " No.1 document " clearly mentions that " grasping the large seed enterprises with the core competitiveness " has aroused strong concern in the industry . In the field of agricultural enterprises , there are fierce competition in intellectual property rights . How can we improve the competitiveness of modern industry in our country ?

In recent years , with the deepening of the reform of science and technology system , agricultural science and technology has been developing greatly .

This paper is divided into four parts .

The first part mainly discusses the object and the right attribute of the new plant species rights and the legitimacy of the independent intellectual property system protection . The new varieties of plants are defined , and the concept and characteristics of the new varieties of plants are expounded through comparison with other knowledge products . At the same time , the analysis methods of law economics , property rights economics theory of law economics , game theory and game theory are used as the theoretical analysis tools to analyze why the protection of the intellectual property rights of the new species of plants is carried out , and the methods which should be followed in the design of the system are explored .

The second part mainly introduces the system method of the protection of new varieties of plants in the USA , Europe , Japan and other countries , so as to explore the developing trend of new species protection of international plants and the challenges faced by our country in the international background .

In the third part , the present situation and protection mechanism of new plant variety protection in China are introduced . The existing problems in the protection system of new plant varieties in China are introduced , and the reasons for its production are analyzed .

In the fourth part , some suggestions are put forward based on the existing problems and reasons of the protection of new plant varieties in our country . First , it puts forward that the innovation of the protection system of the new plant varieties should adhere to the principle of public interest and the principle of balance of interest . Secondly , it puts forward the legal system of the protection of new varieties of plants , the relevant supporting procedures , the reasonable limitation of the rights of new varieties of plants and the strengthening of the four aspects of international cooperation . It is an important mechanism to explore the establishment of new variety protection system adapted to our country ' s development stage , to make it an important mechanism to encourage innovation , optimize resource allocation , adjust interest pattern and maintain order of market competition .
