【摘要】：知識產(chǎn)權(quán)制度是知識產(chǎn)權(quán)保護建設(shè)的基本保障。多年來,我國知識產(chǎn)權(quán)保護一直采用雙軌制模式,即司法保護和行政保護同行,而知識產(chǎn)權(quán)的行政保護是隨著中國第一部《商標法》及《專利法》的實施得以正式確立的。30年的保護實踐證明,在知識產(chǎn)權(quán)保護中行政保護不可替代。同時,我國知識產(chǎn)權(quán)行政保護具有鮮明的中國特色。隨著經(jīng)濟全球化的加快,在現(xiàn)有的知識產(chǎn)權(quán)行政保護體制還不夠完善的背景下,需要行政介入的侵權(quán)案件越多,我們的行政保護呈現(xiàn)的問題也會越多,尤其在地方政府層面,這些問題表現(xiàn)得更加明顯。面對日益嚴峻的國際挑戰(zhàn),地方政府必須不斷地完善現(xiàn)有的知識產(chǎn)權(quán)行政保護體制,著力提高保護水平和效果。本文對寧波市知識產(chǎn)權(quán)行政保護的相關(guān)現(xiàn)狀進行研究,指出在此工作中寧波市存在的瓶頸與問題,并從公共管理的角度提出完善路徑。首先,對知識產(chǎn)權(quán)保護的相關(guān)理論進行梳理和總結(jié),界定相關(guān)概念。接著,著重論述寧波市知識產(chǎn)權(quán)行政保護的現(xiàn)狀和成效,深入分析存在的問題,并剖析問題背后的原因。同時,對國外知識產(chǎn)權(quán)保護的先進制度和成功經(jīng)驗(以美國和日本為例)做了學習和借鑒。最后,從完善寧波市知識產(chǎn)權(quán)行政保護機制的角度提出相關(guān)建議,如加快組織機構(gòu)的職能優(yōu)化;完善知識產(chǎn)權(quán)行政保護的協(xié)調(diào)機制;建設(shè)執(zhí)法隊伍和改革經(jīng)費管理體制,構(gòu)建有效的應急和預警機制,營造良好的行政保護環(huán)境等。
[Abstract]:Intellectual property system is the basic guarantee of intellectual property protection construction. For many years, the protection of intellectual property rights in China has adopted a two-track system, that is, judicial protection and administrative protection. The administrative protection of intellectual property rights has been established with the implementation of the first China Trademark Law and the Patent Law. Thirty years' practice has proved that administrative protection is irreplaceable in the protection of intellectual property rights. At the same time, the administrative protection of intellectual property in China has distinct Chinese characteristics. With the acceleration of economic globalization, under the background that the existing administrative protection system of intellectual property is not perfect, the more infringement cases need administrative intervention, the more problems our administrative protection will present, especially at the local government level. These problems are all the more obvious. In the face of increasingly severe international challenges, local governments must constantly improve the existing administrative protection system of intellectual property rights and strive to improve the level and effect of protection. This paper studies the current situation of administrative protection of intellectual property rights in Ningbo, points out the bottlenecks and problems existing in Ningbo, and puts forward the perfect path from the angle of public administration. First of all, the relevant theories of intellectual property protection are combed and summarized, and related concepts are defined. Then, the paper focuses on the status quo and effect of intellectual property administrative protection in Ningbo, analyzes the existing problems, and analyzes the reasons behind the problems. At the same time, the advanced system and successful experience of foreign intellectual property protection are studied and used for reference. Finally, from the point of view of perfecting the administrative protection mechanism of intellectual property rights in Ningbo, some suggestions are put forward, such as speeding up the optimization of the functions of the organization, perfecting the coordination mechanism of the administrative protection of intellectual property rights, building the law enforcement team and reforming the fund management system, Build an effective emergency and early warning mechanism, create a good administrative protection environment.
