【摘要】：互聯(lián)網(wǎng)的廣泛應(yīng)用空前地改變了人類的生存、生活與生產(chǎn)方式,為人與人之間的交流開拓了一個廣闊而貼近的空間,給人們的生活提供了極大的便利。但與此同時,民事主體的權(quán)益也伴生性地受到來自網(wǎng)上的形形色色的侵害。這些網(wǎng)絡(luò)侵權(quán)行為主要是對知識產(chǎn)權(quán)、個人名譽(yù)權(quán)和隱私權(quán)、公司名譽(yù)權(quán)等的侵權(quán),這不但影響了公民的工作、生活,給公司和個人帶來了巨大的經(jīng)濟(jì)損失,還擾亂了正常的網(wǎng)絡(luò)秩序和有序的競爭秩序。長此以往,甚至還會影響了我國的經(jīng)濟(jì)發(fā)展和社會穩(wěn)定。因此,必須對我國網(wǎng)絡(luò)侵權(quán)監(jiān)管制度進(jìn)行深入研究,找出適合我國互聯(lián)網(wǎng)健康發(fā)展的路子。通過分析我國網(wǎng)絡(luò)侵權(quán)行為,找出其根源,指出我國網(wǎng)絡(luò)監(jiān)管制度的不足：一是網(wǎng)絡(luò)侵權(quán)監(jiān)管法律制度的不完善,缺少相關(guān)法律和細(xì)則,面對新的網(wǎng)絡(luò)侵權(quán)現(xiàn)象,我國的法律常常出現(xiàn)空白；二是沒有獨(dú)立的執(zhí)法部門,執(zhí)法效率低；三是沒有統(tǒng)一的行業(yè)自律規(guī)范；四是沒有嚴(yán)格的市場準(zhǔn)入和退出標(biāo)準(zhǔn)。想要完善我國的網(wǎng)絡(luò)監(jiān)管侵權(quán)制度,必須在借鑒國外先進(jìn)的管理體系的基礎(chǔ)上,結(jié)合我國國情,取長補(bǔ)短。首先要完善法律法規(guī)體系；其次要有步驟的推行網(wǎng)絡(luò)實(shí)名制；再次要建立嚴(yán)格的市場準(zhǔn)入退出制度,限制網(wǎng)絡(luò)信息的內(nèi)容和范圍；然后要加強(qiáng)行業(yè)自律,由政府牽頭建立健全行業(yè)法規(guī)和標(biāo)準(zhǔn),提高網(wǎng)絡(luò)供應(yīng)商的責(zé)任意識；最后要充分發(fā)揮民眾的力量,建立社會各界共同參與、相互協(xié)調(diào)的監(jiān)管體系。
[Abstract]:The extensive application of the Internet has changed the human existence, life and production mode, opened up a broad and close space for the communication between people, and provided great convenience for people's life. But at the same time, the rights and interests of civil subjects have been infringed by all kinds of online. These network infringements are mainly infringements on intellectual property rights, personal reputation and privacy rights, corporate reputation rights, and so on. This not only affects the work and life of citizens, but also brings huge economic losses to companies and individuals. Also disturbed the normal network order and orderly competition order. In the long run, it will even affect the economic development and social stability of our country. Therefore, it is necessary to conduct a thorough study on the supervision system of network infringement in our country and find out a suitable way for the healthy development of the Internet in our country. By analyzing the network tort in our country, we find out its root cause, and point out the shortcomings of our network supervision system: first, the law system of network tort supervision is imperfect, lacking relevant laws and regulations, facing the new phenomenon of network infringement. The law of our country often appears blank; second, there is no independent law enforcement department, enforcement efficiency is low; third, there is no uniform industry self-discipline standard; fourth, there is no strict market access and withdrawal standard. In order to perfect the tort system of network supervision in our country, we must draw lessons from the advanced management system of foreign countries and make up for each other's shortcomings in the light of our country's national conditions. First of all, we should perfect the system of laws and regulations; secondly, we should implement the network real-name system step by step; once again, we should establish a strict system of market access and withdrawal to limit the content and scope of network information; and then we should strengthen the self-discipline of the industry. The government should take the lead to establish and improve the industry laws and standards and improve the responsibility consciousness of the network suppliers. Finally, it is necessary to give full play to the power of the people and establish a supervision system in which all sectors of society participate together and coordinate with each other.
