【摘要】：本文是一篇翻譯報(bào)告，采用的翻譯原文是格拉罕姆·杜菲爾德（GrahamDutfield）和烏瑪·蘇瑟塞恩（Uma Suthersanen）所著的《國際知識(shí)產(chǎn)權(quán)法》（GlobalIntellectual Property Law）的“專利和商業(yè)秘密”一章。該書出版于2008年，從知識(shí)產(chǎn)權(quán)的全球化開始講起，介紹了知識(shí)產(chǎn)權(quán)（包括著作權(quán)、專利、商標(biāo)、外觀設(shè)計(jì)和植物新品種等）在全世界范圍內(nèi)的興起與發(fā)展，在此基礎(chǔ)上，再將知識(shí)產(chǎn)權(quán)與國際人權(quán)、網(wǎng)絡(luò)信息技術(shù)、教育、文化、生態(tài)、生命健康等當(dāng)今全球熱點(diǎn)話題相結(jié)合進(jìn)行討論。筆者采用的該章則系統(tǒng)地介紹了歐美地區(qū)專利法的起源與發(fā)展，從國際的、比較的視角進(jìn)行討論，而非僅僅局限于在某一區(qū)域的案例或制定法的單方面研究，能讓讀者對(duì)歐美地區(qū)專利法的起源與發(fā)展有更為全面的了解，具有較高的參考和翻譯價(jià)值。 本文簡要介紹了翻譯此書時(shí)所遵守的翻譯理論和翻譯原則，主要從詞語和長難句的層面仔細(xì)探討了在翻譯過程中遇到的難點(diǎn)，總結(jié)了筆者在解決這些難點(diǎn)的過程中所運(yùn)用的策略和方法。最后，報(bào)告概括總結(jié)了筆者翻譯該章的體會(huì)，以期為自己之后的翻譯實(shí)踐提供幫助。
[Abstract]:This paper is a translation report in the original text of the chapter "patents and Trade Secrets" by Graham Dutfield and Uma Suthersanenen (International intellectual property Law). Published in 2008, starting with the globalization of intellectual property, the book introduces the rise and development of intellectual property rights (including copyrights, patents, trademarks, designs, new plant varieties, etc.) around the world. Then the intellectual property rights and international human rights, network information technology, education, culture, ecology, life and health and other global hot topics to be discussed. In this chapter, the author systematically introduces the origin and development of patent law in Europe and the United States, and discusses it from an international and comparative perspective, rather than just a case study or a unilateral study of statutory law in a given region. It can make readers have a more comprehensive understanding of the origin and development of patent law in Europe and America, and have higher reference and translation value. This paper briefly introduces the translation theory and translation principles followed in the translation of this book, and mainly discusses the difficulties encountered in the process of translation from the perspective of words and long difficult sentences. The strategies and methods used in solving these difficulties are summarized. Finally, the report summarizes the author's experience in translating this chapter in order to help his translation practice.
