【摘要】：科技創(chuàng)新是企業(yè)發(fā)展的靈魂，也是企業(yè)實(shí)現(xiàn)更快更好發(fā)展的動(dòng)力源泉。在當(dāng)前越來(lái)越激烈的國(guó)際競(jìng)爭(zhēng)中，我們更應(yīng)當(dāng)全面貫徹黨的十八大精神，堅(jiān)定不移的實(shí)施科技創(chuàng)新的戰(zhàn)略，實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略，加強(qiáng)對(duì)知識(shí)產(chǎn)權(quán)保護(hù)，穩(wěn)步推進(jìn)經(jīng)濟(jì)的快速發(fā)展。探索我國(guó)特定背景下民營(yíng)企業(yè)知識(shí)產(chǎn)權(quán)的法律保護(hù)，不僅能夠?yàn)槊駹I(yíng)企業(yè)知識(shí)產(chǎn)權(quán)的發(fā)展?fàn)I造良好的社會(huì)環(huán)境，同時(shí)能夠提高民營(yíng)企業(yè)的創(chuàng)新能力，并為民營(yíng)企業(yè)的發(fā)展發(fā)揮重要作用。 全文分為四章： 第一章闡述了知識(shí)產(chǎn)權(quán)對(duì)民營(yíng)企業(yè)的重要作用。包括：能夠顯著提高企業(yè)的經(jīng)濟(jì)效益；能夠促進(jìn)企業(yè)資產(chǎn)的增長(zhǎng)；有助于提高企業(yè)的核心競(jìng)爭(zhēng)力；有助于企業(yè)提升品質(zhì)，，樹(shù)立良好形象；有助于增強(qiáng)民營(yíng)企業(yè)在國(guó)際上的競(jìng)爭(zhēng)力；以及對(duì)企業(yè)的其他意義。 第二章描述了國(guó)內(nèi)外企業(yè)知識(shí)產(chǎn)權(quán)保護(hù)的現(xiàn)狀。第一部分描述了國(guó)內(nèi)民營(yíng)企業(yè)知識(shí)產(chǎn)權(quán)保護(hù)的現(xiàn)狀，并以湖北省當(dāng)陽(yáng)市為調(diào)查研究對(duì)象，介紹了湖北省當(dāng)陽(yáng)市民營(yíng)企業(yè)知識(shí)產(chǎn)權(quán)保護(hù)的現(xiàn)狀。第二部分描述了美國(guó)知識(shí)產(chǎn)權(quán)保護(hù)現(xiàn)狀，并與我國(guó)的民營(yíng)企業(yè)保護(hù)現(xiàn)狀做了比較，以及日本知識(shí)產(chǎn)權(quán)保護(hù)現(xiàn)狀和其他國(guó)家的知識(shí)產(chǎn)權(quán)保護(hù)狀況。 第三章揭示了我國(guó)民營(yíng)企業(yè)知識(shí)產(chǎn)權(quán)法律保護(hù)中存在的問(wèn)題。主要有：普遍缺乏知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)；知識(shí)產(chǎn)權(quán)保護(hù)的法律法規(guī)不足；政府沒(méi)有充分發(fā)揮行政管理職能；知識(shí)產(chǎn)權(quán)司法體制中存在的問(wèn)題；中介機(jī)構(gòu)和專(zhuān)業(yè)人員數(shù)量不足；維權(quán)成本高，維權(quán)道路艱難。 第四章提出了民營(yíng)企業(yè)知識(shí)產(chǎn)權(quán)法律保護(hù)的建議。保護(hù)措施有：建立民營(yíng)企業(yè)知識(shí)產(chǎn)權(quán)保護(hù)的法律體系；完善執(zhí)法體制，加大執(zhí)法力度；完善司法過(guò)程，提高訴訟效率；加強(qiáng)知識(shí)產(chǎn)權(quán)立法、行政、司法三方面的協(xié)調(diào)工作；加強(qiáng)對(duì)中介服務(wù)機(jī)構(gòu)的管理。
[Abstract]:Scientific and technological innovation is the soul of enterprise development, and also the power source of enterprise to achieve faster and better development. In the current increasingly fierce international competition, we should fully implement the spirit of the 18th CPC National Congress, unswervingly implement the strategy of scientific and technological innovation, implement the strategy of intellectual property rights, and strengthen the protection of intellectual property rights. We will steadily promote rapid economic development. Exploring the legal protection of intellectual property rights of private enterprises under the specific background of our country can not only create a good social environment for the development of intellectual property rights of private enterprises, but also improve the innovation ability of private enterprises. And for the development of private enterprises play an important role. The full text is divided into four chapters: The first chapter expounds the important role of intellectual property to private enterprises. Including: can significantly improve the economic benefits of enterprises; can promote the growth of enterprise assets; help to improve the core competitiveness of enterprises; help enterprises to improve quality and establish a good image; Help to enhance the international competitiveness of private enterprises; and other implications for enterprises. The second chapter describes the current situation of intellectual property protection at home and abroad. The first part describes the current situation of intellectual property protection of domestic private enterprises, and takes Dangyang City of Hubei Province as the research object, and introduces the present situation of the protection of intellectual property rights of private enterprises in Dangyang City, Hubei Province. The second part describes the current situation of intellectual property protection in the United States, and compares it with the current situation of private enterprises in China, as well as the current situation of intellectual property protection in Japan and other countries. The third chapter reveals the problems existing in the legal protection of intellectual property rights of private enterprises in China. The main problems are: the general lack of awareness of intellectual property protection; the lack of laws and regulations for intellectual property protection; the government does not give full play to the functions of administration; the problems in the intellectual property judicial system; the insufficient number of intermediary organizations and professionals; The cost of safeguarding rights is high, and the road of safeguarding rights is difficult. The fourth chapter puts forward the suggestion of legal protection of intellectual property of private enterprises. The protection measures include: establishing a legal system for intellectual property protection of private enterprises; perfecting the law enforcement system and strengthening the enforcement of law; perfecting the judicial process and improving the efficiency of litigation; strengthening the coordination of intellectual property legislation, administration and justice; Strengthen the management of intermediary services.
