【摘要】：司法實(shí)踐中,知識(shí)產(chǎn)權(quán)犯罪存在追訴乏力的問(wèn)題。為解決這些問(wèn)題,從公安機(jī)關(guān)的角度來(lái)講,應(yīng)當(dāng)完善知識(shí)產(chǎn)權(quán)犯罪偵查程序,強(qiáng)化偵查協(xié)作機(jī)制;從行政執(zhí)法機(jī)關(guān)和刑事執(zhí)法機(jī)關(guān)關(guān)系的角度來(lái)講,應(yīng)當(dāng)完善知識(shí)產(chǎn)權(quán)犯罪案件的移送制度,健全行政證據(jù)適用于知識(shí)產(chǎn)權(quán)刑事訴訟制度,完善行政執(zhí)法機(jī)關(guān)與刑事司法機(jī)關(guān)信息溝通制度,引入公安機(jī)關(guān)提前介入制度;從檢察機(jī)關(guān)角度來(lái)講,應(yīng)當(dāng)完善知識(shí)產(chǎn)權(quán)犯罪審查起訴程序、刑事立案監(jiān)督制度,明確知識(shí)產(chǎn)權(quán)公訴案件刑事和解制度的適用;對(duì)于知識(shí)產(chǎn)權(quán)犯罪案件的自訴,應(yīng)當(dāng)完善知識(shí)產(chǎn)權(quán)犯罪案件專家輔助人制度和律師代理制度。
[Abstract]:In judicial practice, there is a problem of lack of prosecution of intellectual property crimes. In order to solve these problems, from the point of view of the public security organs, we should perfect the investigation procedure of intellectual property crimes and strengthen the investigation cooperation mechanism; from the angle of the relationship between the administrative law enforcement agencies and the criminal law enforcement agencies, We should perfect the transfer system of intellectual property crime cases, perfect the administrative evidence applicable to the criminal litigation system of intellectual property rights, perfect the information communication system between the administrative law enforcement agencies and the criminal justice organs, and introduce the public security organs to intervene in advance. From the point of view of procuratorial organs, we should perfect the procedure of reviewing and prosecuting intellectual property crimes, the system of criminal filing and supervision, the application of criminal reconciliation system in intellectual property prosecution cases, and the private prosecution of intellectual property crimes, We should perfect the system of expert assistant and lawyer's agent in intellectual property crime cases.
