【摘要】：軍民協(xié)同創(chuàng)新活動(dòng)中,知識(shí)產(chǎn)權(quán)歸屬問(wèn)題是影響協(xié)同創(chuàng)新成效的重要因素。據(jù)此,提出計(jì)劃主導(dǎo)、計(jì)劃市場(chǎng)共同作用和市場(chǎng)主導(dǎo)3種軍民協(xié)同創(chuàng)新模式,分析了軍民協(xié)同創(chuàng)新知識(shí)產(chǎn)權(quán)歸屬的主要問(wèn)題。計(jì)劃主導(dǎo)、計(jì)劃市場(chǎng)共同作用、市場(chǎng)主導(dǎo)3種模式下的知識(shí)產(chǎn)權(quán)歸屬應(yīng)分別堅(jiān)持"平衡利益、鼓勵(lì)創(chuàng)新"、"注重效率、側(cè)重長(zhǎng)遠(yuǎn)"、"經(jīng)濟(jì)效率優(yōu)先"原則,相應(yīng)地采取"法律規(guī)范、兼顧合約"、"章程式契約"、"尊重市場(chǎng)、契約優(yōu)先"的思路進(jìn)行制度設(shè)計(jì)。同時(shí),還要從軍民融合深度發(fā)展戰(zhàn)略、知識(shí)產(chǎn)權(quán)保護(hù)環(huán)境、配套政策舉措、法律制度等方面提供外部環(huán)境保障和激勵(lì)。
[Abstract]:The ownership of intellectual property is an important factor affecting the effectiveness of military and civilian collaborative innovation. On the basis of this, three modes of military-civilian collaborative innovation are put forward, which are plan-oriented, plan-market and market-oriented, and the main problems of the ownership of military-civilian collaborative innovation intellectual property are analyzed. The ownership of intellectual property under the three modes of "balancing interests, encouraging innovation", "paying attention to efficiency, focusing on the long term", "giving priority to economic efficiency", and adopting the principle of "legal norms" should be adhered to in the three modes of "plan leading, plan market and market leading", respectively. Considering the contract, the chapter-formula contract and the "respect the market, the contract is the first" to carry on the system design. At the same time, we should provide external environment protection and encouragement from military and civil integration strategy, intellectual property protection environment, supporting policy measures, legal system and so on.
