【摘要】：國際知識產(chǎn)權(quán)法律正在逐步走向一體化,這就需要有一個(gè)共同的標(biāo)準(zhǔn),然而《TRIPS協(xié)議》的要求就滿足了這樣的標(biāo)準(zhǔn)�！禩RIPS協(xié)議》是WTO法律制度的重要組成部門,我國雖然已經(jīng)初步建立了知識產(chǎn)權(quán)保護(hù)體系,但與《TRIPS協(xié)議》相比還有一定的差距。本文首先對《TRIPS協(xié)議》的宗旨和內(nèi)容進(jìn)行了概括敘述,進(jìn)而闡述了《TRIPS協(xié)議》對各成員國在總義務(wù)、民事和行政程序及救濟(jì)、臨時(shí)措施、邊境措施及刑事程序等五個(gè)方面的有關(guān)要求,然后總結(jié)了我國知識產(chǎn)權(quán)的保護(hù)現(xiàn)狀,進(jìn)而分析了我國與《TRIPS協(xié)議》之間的差距,在此基礎(chǔ)上對我國知識產(chǎn)權(quán)保護(hù)提出了相應(yīng)的完善措施,希望以此來解決我國知識產(chǎn)權(quán)保護(hù)存在的問題。
[Abstract]:International intellectual property law is gradually moving towards integration, which requires a common standard. However, the requirements of the TRIPS Agreement meet such standards. < TRIPS Agreement > is an important component of the WTO legal system. Although our country has initially established the intellectual property protection system, there is still a certain gap compared with the TRIPS Agreement. In this paper, the purpose and content of the TRIPS Agreement are summarized, and then the general obligations, civil and administrative procedures, relief and interim measures of the TRIPS Agreement to the member States are expounded. Border measures and criminal procedures and other relevant requirements, and then summed up the current situation of intellectual property protection in China, and then analyzed the gap between China and the "TRIPS Agreement", On this basis, the author puts forward the corresponding measures to improve the protection of intellectual property rights in China, hoping to solve the problems existing in the protection of intellectual property rights in China.
