【摘要】：廣播組織權(quán)是著作權(quán)中屬于鄰接權(quán)的一項重要內(nèi)容,是隨著廣播技術(shù)的誕生而產(chǎn)生的。而隨著數(shù)字化和互聯(lián)網(wǎng)技術(shù)的不斷發(fā)展,現(xiàn)有的廣播組織權(quán)制度已呈現(xiàn)出局限性和滯后性。為了適應(yīng)新技術(shù)的發(fā)展需要,世界知識產(chǎn)權(quán)組織各成員國都致力于完善廣播組織權(quán),中國也正在對《著作權(quán)法》進行第三次修訂,本文在理清廣播組織權(quán)基本發(fā)展脈絡(luò)和主要內(nèi)容的基礎(chǔ)上,重點就國際和國內(nèi)對廣播組織權(quán)的改革進行了分析,國際層面重點對《世界知識產(chǎn)權(quán)組織保護廣播組織條約(草案)》(以下簡稱《廣播組織條約草案》)及其之后的其他重要會議文件進行了評述,國內(nèi)方面則著眼于《著作權(quán)法》第三次修訂過程中的幾次修改草案進行了比較分析,最后得出對廣播組織權(quán)的完善建議。正文主要分五個部分詳細論述:第一,廣播組織權(quán)概述,包括廣播組織權(quán)的產(chǎn)生及其構(gòu)成,以及我國對廣播組織的規(guī)定;第二,網(wǎng)絡(luò)時代廣播組織權(quán)制度面臨的挑戰(zhàn),從廣播組織權(quán)主體、客體和內(nèi)容三個方面論述,不僅從理論上進行分析,還引入司法實踐中的案例進行說明;第三,廣播組織權(quán)制度的國際變革,對世界知識產(chǎn)權(quán)組織召開的會議和形成的《世界知識產(chǎn)權(quán)組織保護廣播組織條約草案》及其他重要會議文件進行分析;第四,我國對廣播組織權(quán)的立法完善,包括《著作權(quán)法》修訂草案的評析和相關(guān)制度變革評析;第五,網(wǎng)絡(luò)時代廣播組織權(quán)完善建議,從利益平衡的角度,提出要平衡發(fā)達國家和發(fā)展中國家之間、傳統(tǒng)廣播組織和新興廣播組織之間、廣播組織和社會公眾之間的利益,并提出具體的制度設(shè)計:完善集體管理制度成立廣播組織行業(yè)協(xié)會、完善合理使用和適當限制制度等等。本文創(chuàng)新之處在于采用縱向和橫向比較的方式對從國際和國內(nèi)兩個層面上對網(wǎng)絡(luò)時代廣播組織權(quán)的保護進行分析:縱向梳理世界知識產(chǎn)權(quán)組織版權(quán)及相關(guān)權(quán)常委會召開的專門會議以及所形成的重要文件與國內(nèi)《著作權(quán)法》幾次修訂稿對廣播組織權(quán)的改革之處,通過縱向梳理,可以對廣播組織權(quán)制度改革有清晰的認識,同時也能更好地把握改革的發(fā)展趨勢;縱向梳理之后再進行國際和國內(nèi)橫向?qū)Ρ?使得本文論據(jù)更為充分,結(jié)論更有立體感。通過這種對比,希望達到本文的寫作目的,即互相參考借鑒,為我國廣播組織權(quán)的制度改革提供更全面的建議和更有力的智力支持,深入認識網(wǎng)絡(luò)時代廣播組織權(quán)的保護問題,并解決相關(guān)的實務(wù)糾紛,實現(xiàn)積極保護和鼓勵創(chuàng)新的目的,取得多方利益平衡的局面。
[Abstract]:The right of broadcasting organization is an important part of the copyright belonging to the neighboring right, which comes into being with the birth of broadcasting technology.With the development of digital technology and Internet technology, the existing broadcasting organization right system has shown the limitation and lag.In order to meet the needs of the development of new technologies, all member countries of the World intellectual property Organization are committed to improving the right of broadcasting organizations. China is also making a third revision of the copyright Law.On the basis of clarifying the basic development context and main contents of broadcasting organization right, this paper analyzes the reform of broadcasting organization right at home and abroad.Focusing at the international level on the World intellectual property Organization Treaty for the Protection of Broadcasting Organization (draft) (hereinafter referred to as the draft Broadcasting Organization Treaty) and other important conference documents that follow,At home, the author makes a comparative analysis of several amendments in the process of the third revision of the copyright Law, and finally puts forward some suggestions for the improvement of the right of broadcasting organization.The main body is divided into five parts in detail: first, the outline of the right of broadcasting organization, including the emergence and composition of the right of broadcasting organization, as well as the provisions of broadcasting organization in China; second, the challenges faced by the system of the right of broadcasting organization in the era of network.From three aspects of the subject, object and content of the right of broadcasting organization, it not only analyzes theoretically, but also introduces the cases in judicial practice to explain; third, the international reform of the system of broadcasting organization right.It analyzes the conference convened by the World intellectual property Organization (WIPO), the draft Treaty on the Protection of Broadcasting Organization of the World intellectual property Organization (WIPO) and other important conference documents. Fourth, the legislation on the right of broadcasting organization in China is improved.Including the review of the revised draft of the copyright Law and the analysis of relevant institutional changes. Fifth, the proposal to improve the right of broadcasting organizations in the Internet age, from the angle of balance of interests, proposes to balance between developed and developing countries.Between the traditional broadcasting organization and the new broadcasting organization, between the broadcasting organization and the public, and puts forward the concrete system design: consummates the collective management system to set up the broadcasting organization profession association, consummates the reasonable use and the appropriate restriction system and so on.The innovation of this paper lies in the analysis of the protection of broadcasting organization right at the international and domestic levels by means of vertical and horizontal comparison: a vertical review of the WIPO standing Committee on copyright and related RightsThe special meetings held at the conference and the important documents formed and the reform of broadcasting organization rights by several revisions of the domestic copyright Law,Through vertical combing, we can have a clear understanding of the reform of broadcasting organization right system, but also better grasp the development trend of the reform.The conclusion is more stereoscopic.Through this kind of contrast, I hope to achieve the purpose of writing this article, that is, to refer to each other, to provide more comprehensive suggestions and more powerful intellectual support for the reform of broadcasting organization right system in our country, and to deeply understand the protection of broadcasting organization right in the network age.And to solve the relevant practical disputes, to achieve the purpose of actively protecting and encouraging innovation, and to achieve a balance of interests.
