【摘要】：知識(shí)產(chǎn)權(quán)能夠鼓勵(lì)創(chuàng)造系知識(shí)產(chǎn)權(quán)制度功能的通常解說,該說法及其依據(jù)的歷史素材之間存在循環(huán)論證的嫌疑。事實(shí)上,經(jīng)由不同價(jià)值導(dǎo)向進(jìn)行的歷史闡釋呈現(xiàn)出更加豐富的知識(shí)產(chǎn)權(quán)制度發(fā)展歷程,揭示出鼓勵(lì)創(chuàng)造說極有可能是一種倒果為因的立法策略。橫向比較古代中國知識(shí)產(chǎn)權(quán)制度萌芽及受阻的過程,將發(fā)現(xiàn)強(qiáng)大的利益訴求與社會(huì)認(rèn)可而非鼓勵(lì)創(chuàng)造的期待是形成知識(shí)產(chǎn)權(quán)制度的重要原因,進(jìn)而澄清制度功能并非價(jià)值詮釋,而是事實(shí)描述這一基本問題。知識(shí)產(chǎn)權(quán)最重要的制度功能在于為作品、發(fā)明、商標(biāo)這些信息提供市場化的制度環(huán)境,在不同的社會(huì)主體之間分配基于這些信息產(chǎn)生的利益。
[Abstract]:Intellectual property can encourage the creation of a general explanation of the functions of the intellectual property system, and there is a suspicion of circular argumentation between this statement and the historical material on which it is based.As a matter of fact, the historical interpretation through different value orientation presents a richer course of development of intellectual property system, which reveals that encouraging the creation theory is probably a kind of legislative strategy of reversing the result and the cause.Comparing the process of germination and hindrance of intellectual property system in ancient China, it will be found that strong interest demand and social recognition rather than expectation of encouraging creation are the important reasons for the formation of intellectual property system, and then clarify that the function of the system is not a value annotation.It is a factual description of the basic question.The most important institutional function of intellectual property is to provide a market-oriented institutional environment for the information of works, inventions and trademarks, and to distribute the benefits arising from these information among different social subjects.
