【摘要】：選取了世界數(shù)字圖書館、歐洲數(shù)字圖書館Europeana等六個國外典型的公共數(shù)字文化資源整合項目,通過網(wǎng)絡調研和案例分析等方法,歸納了各項目為平衡著作權人、資源整合方、終端用戶等各方利益所采取的版權清理、法律聲明、保護公有領域、使用創(chuàng)作共用許可協(xié)議、合理利用孤兒作品等知識產權策略。并就我國公共數(shù)字文化資源整合項目如何加強知識產權風險控制、有效保障公共利益空間提出了幾點建議。
[Abstract]:This paper selects six typical foreign digital cultural resources integration projects, such as the world digital library and the European digital library Europeana. Through network investigation and case analysis, the author concludes that each project is a balanced copyright owner and a resource integrator.Copyright clearance, legal statements, protection of the public domain, use of creative common license agreements, rational use of orphan works and other intellectual property strategies adopted by end users and other parties.Some suggestions on how to strengthen the risk control of intellectual property rights and ensure the space of public interest are put forward.
