【摘要】：合理使用制度又稱“自由使用”。是指在公平合理的范圍內(nèi)，可以不經(jīng)著作權(quán)人的同意，也不必支付報(bào)酬而自由使用他人作品的一種著作權(quán)法律制度。知識(shí)產(chǎn)權(quán)法律制度將促進(jìn)文學(xué)藝術(shù)與科學(xué)技術(shù)的進(jìn)步與傳播視為核心價(jià)值所在。著作權(quán)法律制度作為知識(shí)產(chǎn)權(quán)法律制度的一部分，旨在促進(jìn)文學(xué)藝術(shù)作品的不斷創(chuàng)作和連續(xù)傳播。信息網(wǎng)絡(luò)傳播技術(shù)的不斷更新與飛速發(fā)展下的網(wǎng)絡(luò)傳播環(huán)境給著作權(quán)法律制度帶來了信息時(shí)代特定背景下賦予它的挑戰(zhàn)，同時(shí)也將為其帶來傳統(tǒng)模式下未曾遇見過的發(fā)展機(jī)遇。 著作權(quán)法所追求的目標(biāo)之一即是創(chuàng)作者、使用者、傳播者之間的利益平衡，通過利益的均衡促進(jìn)文學(xué)藝術(shù)、科學(xué)技術(shù)事業(yè)的發(fā)展是合理使用制度的價(jià)值目標(biāo)。 本文旨在通過梳理著作權(quán)合理使用制度的發(fā)展脈絡(luò)探究網(wǎng)絡(luò)傳播環(huán)境中合理使用制度的歷史與現(xiàn)狀并結(jié)合網(wǎng)絡(luò)傳播環(huán)境中合理使用制度面臨的問題，從而分析其存在與進(jìn)一步發(fā)展的意義，同時(shí)借鑒國外的相關(guān)規(guī)定與經(jīng)驗(yàn)，通過論證，進(jìn)而從理論上提出完善我國著作權(quán)合理使用制度的思路與措施。文章分為四個(gè)部分。 第一章梳理著作權(quán)合理使用制度的發(fā)展脈絡(luò)，介紹著作權(quán)合理使用制度的產(chǎn)生基礎(chǔ)和立法動(dòng)因；第二章介紹網(wǎng)絡(luò)環(huán)境下的著作權(quán)合理使用制度及網(wǎng)絡(luò)傳播技術(shù)給網(wǎng)絡(luò)環(huán)境下著作權(quán)合理使用制度帶來的問題與沖擊；第三章通過國際條約和國外的立法，介紹網(wǎng)絡(luò)環(huán)境下合理使用制度的發(fā)展?fàn)顩r；第四章針對我國的著作權(quán)合理使用制度，給出進(jìn)一步的完善建議并有針對性的分析其發(fā)展方向。
[Abstract]:The system of rational use is also called "free use".It refers to a kind of copyright legal system in which the copyright owner can freely use the works of others without the consent of the copyright owner and without paying remuneration within a fair and reasonable scope.The intellectual property legal system regards the progress and dissemination of literature, art and science and technology as the core value.As a part of intellectual property law system, copyright legal system aims to promote the continuous creation and continuous dissemination of literary and artistic works.The continuous updating of the information network communication technology and the rapid development of the network communication environment have brought the copyright legal system a challenge given to it under the specific background of the information age, and will also bring it a development opportunity that has not been met in the traditional mode.One of the aims pursued by copyright Law is the balance of interests among creators, users and communicators, and the development of science and technology is the value goal of the rational use of the system through the balance of interests to promote literature and art.The purpose of this paper is to explore the history and present situation of the reasonable use system in the network communication environment by combing the development of the fair use system of copyright, and combining with the problems faced by the reasonable use system in the network communication environment.Then it analyzes the significance of its existence and further development, and at the same time draws lessons from the relevant regulations and experiences of foreign countries, through demonstration, and then puts forward the ideas and measures to perfect the system of the rational use of copyright in our country theoretically.The article is divided into four parts.The first chapter combs the development of the fair use of copyright system, introduces the basis of the fair use of copyright system and legislative motivation;The second chapter introduces the system of fair use of copyright in the network environment and the problems and impacts brought by the network communication technology to the fair use of copyright in the network environment. Chapter three adopts international treaties and foreign legislation.This paper introduces the development of the reasonable use system in the network environment, the fourth chapter gives further suggestions for the reasonable use of copyright in our country and analyzes its development direction.
