【摘要】：隨著我國(guó)知識(shí)產(chǎn)權(quán)戰(zhàn)略的實(shí)施，發(fā)展自主知識(shí)產(chǎn)權(quán)越來(lái)越得到人們的重視。專利制度作為知識(shí)產(chǎn)權(quán)的重要制度理應(yīng)得到重視。專利權(quán)利要求解釋是維護(hù)專利權(quán)人專利權(quán)的重要依據(jù)，是衡量一國(guó)專利發(fā)展水平的重要指標(biāo)。文章以專利權(quán)利要求解釋為線索，，對(duì)專利權(quán)利要求解釋的概念與性質(zhì)進(jìn)行界定，對(duì)有權(quán)作出專利權(quán)利要求解釋的主體進(jìn)行評(píng)析，論述了專利權(quán)利要求解釋的解釋原則和侵權(quán)判定標(biāo)準(zhǔn)，最后結(jié)合我國(guó)當(dāng)前立法現(xiàn)狀提出建議。以期我國(guó)自主專利發(fā)展取得更高成就。全文共分四部分： 第一部分對(duì)專利權(quán)利要求解釋做了理論奠基。對(duì)專利權(quán)利要求解釋的概念和性質(zhì)做了界定。提出法院是進(jìn)行專利權(quán)利解釋的適格主體，對(duì)專利權(quán)利解釋必要性進(jìn)行分析，認(rèn)為對(duì)專利權(quán)利進(jìn)行合法合理的解釋是專利制度發(fā)展的不竭動(dòng)力。 第二部分對(duì)專利權(quán)利解釋的原則進(jìn)行論述，介紹了“周邊限定”、“中心限定”、“折中原則”等解釋原則。提出了專利權(quán)利解釋的貫常解釋方法。 第三部分介紹了專利權(quán)利解釋的侵權(quán)判定方式。在不同判定原則下，對(duì)專利是否構(gòu)成侵權(quán)的判定有不同的法律后果。 第四部分結(jié)合我國(guó)當(dāng)前的立法狀況，尋求立法之空白。提出了法律完善建議。
[Abstract]:With the implementation of intellectual property strategy in China, people pay more and more attention to the development of independent intellectual property rights.Patent system as an important system of intellectual property rights should be attached importance to.The interpretation of patent claims is an important basis for maintaining patent rights of patentee and an important index to measure the level of patent development in a country.This paper defines the concept and nature of the interpretation of patent claims and comments on the subjects who have the right to interpret patent claims, taking the interpretation of patent claims as a clue.This paper discusses the interpretation principle of patent claim interpretation and the judgment standard of infringement, and finally puts forward some suggestions combined with the current legislation situation of our country.Expect our country independent patent development to obtain higher achievement.The full text is divided into four parts:The first part lays a theoretical foundation for the interpretation of patent claims.The concept and nature of the interpretation of patent claims are defined.It is pointed out that the court is the appropriate subject for the interpretation of patent rights. The necessity of the interpretation of patent rights is analyzed, and the legal and reasonable interpretation of patent rights is considered to be the inexhaustible motive force for the development of patent system.The second part discusses the principles of patent right interpretation, including peripheral limitation, central limitation and compromise principle.This paper puts forward the method of consistent interpretation of patent right interpretation.The third part introduces the way of infringement adjudication of patent right interpretation.Under different judgment principles, there are different legal consequences on whether a patent constitutes an infringement.The fourth part combines our country's current legislative situation, seeks the blank of legislation.Some suggestions for the perfection of the law are put forward.
