【摘要】：自2012年10月11日中國作家莫言獲得2012年度諾貝爾文學(xué)獎(jiǎng)之后,莫言作品霎時(shí)間風(fēng)靡神州,一時(shí)間洛陽紙貴,伴隨著這股"莫言熱"席卷華夏之勢,莫言作品著作權(quán)遭侵犯也是此起彼伏。首先是多家出版社合同到期依舊印刷莫言作品出售,或者超出授權(quán)范圍出版莫言作品,其次是私販小攤盜印書籍更是猖獗肆虐、肆無忌憚地大量印刷販賣,再者是網(wǎng)絡(luò)平臺(tái)未經(jīng)作者同意大量免費(fèi)提供數(shù)字化處理后的莫言作品,最后是莫言作品文字翻譯方面的侵權(quán)。以上侵權(quán)都以莫言著作權(quán)為核心展開,無怪乎"莫言獲獎(jiǎng)"竟當(dāng)選2012年度十個(gè)全國知識(shí)產(chǎn)權(quán)保護(hù)重大事件。本文通過莫言作品侵權(quán)類型化分析闡述莫言作品權(quán)利侵害現(xiàn)狀,指出莫言著作權(quán)遭侵害救濟(jì)不足的原因與不足,最終提出莫言著作權(quán)侵權(quán)救濟(jì)措施,實(shí)現(xiàn)莫言文學(xué)作品著作權(quán)的合理有效保護(hù)。
[Abstract]:Since Mo Yan, a Chinese writer, won the 2012 Nobel Prize for Literature on October 11, 2012, Mo Yan's works have suddenly become popular in China.Mo Yan works copyright infringement is also one after another.First, many publishing houses still print Mo Yan's works for sale at the end of their contracts, or they publish Mo Yan's works beyond the authorized scope. Secondly, the private vendors, small stalls, stealing and printing books are rampant, and they are rampant in large numbers of unscrupulous printing and selling.Moreover, the network platform provides a large number of digitalized works without the consent of the author, and finally the copyright infringement in the translation of Mo Yan's works.The above infringement centers on Mo Yan's copyright. No wonder Mo Yan won the prize in 2012 as the top 10 national intellectual property protection event.Based on the analysis of the types of infringement of Mo Yan's works, this paper expounds the current situation of the infringement of Mo Yan's works, points out the causes and shortcomings of the insufficient remedies for Mo Yan's copyright infringement, and finally puts forward the remedy measures for Mo Yan's copyright infringement.To realize the reasonable and effective protection of the copyright of Mo Yan's literary works.
