【摘要】：人類已經(jīng)進入基因技術(shù)時代，基因所蘊含的財產(chǎn)價值也日漸顯現(xiàn)�；蚣夹g(shù)的研究開發(fā)在給研究者、企業(yè)等帶來了巨大經(jīng)濟利益的同時，，基因信息提供者的財產(chǎn)權(quán)益保護卻被忽視。人類基因提供者對于基因研究帶來的收益應(yīng)該享有利益分享權(quán)，在法理上是基于基因信息財產(chǎn)權(quán)問題，這是跟傳統(tǒng)的所有權(quán)或者知識產(chǎn)權(quán)不同的一種新型獨立權(quán)利。在我國現(xiàn)實的法律環(huán)境下，亟待為基因信息提供者確立一個合理適宜的方式來保護其財產(chǎn)權(quán)益。 本文主要內(nèi)容由導(dǎo)論、關(guān)于人類基因的法律定位的問題、對于基因信息財產(chǎn)保護的模式選擇的問題、關(guān)于基因信息財產(chǎn)權(quán)的制度架構(gòu)的問題、關(guān)于保護我國基因信息提供者權(quán)益的立法探索等五個部分組成。在研究方法上，主要采用了比較研究、綜合分析、法學(xué)以及邏輯學(xué)分析等方法。 第一章導(dǎo)論部分從當前基因技術(shù)的發(fā)展狀況入手，提出由此引發(fā)的法律問題，并指出解決問題的關(guān)鍵在于明確界定個人基因信息的法律屬性和定位，在此基礎(chǔ)上，找尋基因信息提供者利益保護的新路徑。 第二章“人類基因的法律定位”在梳理基因和基因信息兩個基礎(chǔ)概念的區(qū)別后，明確人類基因的核心價值并非基因本身而是基因上所承載的信息。這樣的定位更為科學(xué)合理，為后文人類基因信息財產(chǎn)權(quán)的探討也提供了基礎(chǔ)性鋪墊。 第三章“基因信息財產(chǎn)保護的模式選擇”在對比分析了各國目前對基因信息提供者的保護模式主要采取隱私權(quán)模式和侵權(quán)法保護模式的基礎(chǔ)上，分析論證對于基因信息提供者進行財產(chǎn)權(quán)模式保護的合理性和必要性。 第四章“基因信息財產(chǎn)權(quán)的制度架構(gòu)”對基因信息財產(chǎn)權(quán)的含義、主體、客體、內(nèi)容、權(quán)利實現(xiàn)途徑和權(quán)利救濟進行了一些探討，明確了基因信息財產(chǎn)權(quán)作為一種獨立存在的新型財產(chǎn)權(quán)在實質(zhì)上與其他權(quán)利的不同。 第五章“我國基因信息提供者權(quán)益保護的立法探索”，結(jié)合國外立法實踐，充分考慮我國國情，提出采用《民法典》為主，時機成熟再制定專門的基因信息保護法的模式，為了解決權(quán)利沖突問題，在其中對立法原則和制度安排提出一些設(shè)想。
[Abstract]:Human beings have entered the era of genetic technology, and the value of genetic property is becoming increasingly apparent. The research and development of gene technology has brought great economic benefits to researchers, enterprises, etc. The protection of the property rights and interests of genetic information providers is ignored. Human gene providers should have the right to share benefits from genetic research, which is based on the issue of property rights of genetic information. This is a new type of independent right different from the traditional ownership or intellectual property rights. In the actual legal environment of our country, it is urgent to establish a reasonable and appropriate way for genetic information providers to protect their property rights and interests. The main content of this paper is the introduction, the legal positioning of human genes, the choice of the mode of protection of genetic information property, the institutional framework of the property rights of genetic information. There are five parts about the legislative exploration of protecting the rights and interests of genetic information providers in China. In the research methods, we mainly adopt the methods of comparative study, comprehensive analysis, law and logic analysis. The first chapter introduces the current development of gene technology, and points out that the key to solve the problem is to clearly define the legal attributes and location of personal genetic information. To find a new way to protect the interests of genetic information providers. Chapter two, "legal positioning of human genes", after combing the difference between two basic concepts of gene and gene information, it is clear that the core value of human gene is not the gene itself but the information carried on the gene. This kind of localization is more scientific and reasonable. It also provides the foundation for the discussion of the property right of human genetic information. Chapter three, "Model selection of genetic Information property Protection", compares and analyzes the current protection models of genetic information providers in various countries, which are mainly privacy protection mode and tort protection model. The rationality and necessity of protecting the property rights of genetic information providers are demonstrated. Chapter four, "the Institutional Framework of the property right of genetic Information", discusses the meaning, subject, object, content, realization way and right relief of the property right of genetic information. It is clear that the property right of genetic information, as an independent new property right, is essentially different from other rights. The fifth chapter "the legislation exploration of the protection of the rights and interests of the gene information provider in our country", combining with the foreign legislative practice, fully considering the national conditions of our country, put forward the mode of adopting "Civil Code" as the main body and making the special gene information protection law again when the time is ripe. In order to solve the conflict of rights, some tentative ideas are put forward for legislative principles and institutional arrangements.
